70R-390 IU:SOLUTION NO. 70R-390 A RESOLUTIO~ OF THE CITY COUNCIL OF THE CITY OF AN^*EIM FINDING AND DETERMINING THAT TITLE ~8 OF THE ANAHEIM MUNICIPAL CODE RELATI$G TO ZONING SHOULD BE AMENDED AND THAT THt BOUNDARIES OF CERTAIN ZONES SHOULD BE C~ANGED. WHEREAS, th~ City Planning Commission of the City of Anaheim did hold a pu~lic hearing in Reclassification Proceed- ings No. 70-71-3 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 4th day of August , 19 70 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the city Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 70-71-3 -1- That portion o. the Southeast quarter of the Northeast quarter of Sec~ion 17, Township 4 South, Range 10 West, in the Rancho ~os Coyotes, in the City of Anaheim, as per map record~d in Book 51, page 10, Miscellaneous Maps in the Office qf the County Recorder of said County, des- cribed as follows: Beginning at tqe intersection of the Easterly prolongation of the Souther~y line of Lot 76 of Tract No. 2402, as per Map recorded in Book 79, pages 37, 38 and 39, Miscellaneous Maps, in the O.fice of the County Recorder of said County, with the cente~line of Euclid Avenue as shown on said Map and running th~nce Southerly along said centerline 166 feet to a point; thence Westerly parallel with the Southerly line of said Lot 76 to a point in the Easterly line of said Tract 2402; th~nce Northerly along said Easterly line to the Southwesteily corner of said Lot 76; thence Easterly along the Southerly line of said lot and the Easterly pro- longation ther~of to the point of beginning. EXCEPT the Southerly 66 feet. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incorpora- ted in C-1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the Qwner of subject property shall deed to the City of A4aheim a strip of land 53 feet in width from the centei1ine of the street along Euclid Street for street wi4ening purposes. 2. That the qwner of subject property shall pay to the City of ~aheim the sum of 15c per front foot along Euclid Stteet, for tree planting purposes. 3. That the Owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Euclid Stteet, for street lighting purposes. 4. That the Owners of subject property shall provide a 20-foot wide vehicular accessway along the westerly boundary and a 10-foot wide vehicular accessway along the northerly boundary of the property upon demand by the City, said vehicular accessways shall be paved in accordance with the requirements of the Director of Public Works. 5. That mutu~l easement rights to and over the required private v~hicular accessways shall be granted to all other property owners included in Area Development Plan No. 95 upon demand by the City; said easement rights shall be submitted to and approved by the City Attorney and then be recorded with the Orange County Recorder. 6. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 7. That a 6-.oot masonry wall shall be constructed along the west ~roperty line. 8. That the existing structure shall be brought up to the -2- m~n~um s~andards of the City of Anaheim, including the Unifo~ Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. 9. That a pa~el map to record the approved division of subject p~perty be submitted to and approved by the City of Aqaheim and then be recorded in the Office of the Orange' County Recorder. 10. That subj~t property be developed in accordance with Area Develbpment Plan No. 95. 11. That fire hydrants shall be installed as required and determined! to be necessary by the Chief of the Fire Department. 12. That all ~r-conditioning facilities shall be properly shielded f~om view and the sound buffered from adjacent residences. 13. That any ~rking area lighting proposed shall be down- lighting o~ a maximum height of 6 feet, which lighting shall be d~rected away from the property lines to pro- tect the residential integrity of the area. 14. That the f~nal parking plans shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with 6-inch high concrete curbs, and concrete wheel stops shall be p~ovided for parking spaces as required by the Develo~ment Services Department. 15. That subject property shall be developed substantially in accordapce with plans and specifications on file with the C~ty of Anaheim, marked Exhibits Nos. 1 and 2, providea that necessary revisions are made to comply with Area Oeve1opment Plan No. 95. 16. That prior to the introduction of an ordinance rezoning subject property, Conditions No.1, 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said condi- tions are complied with within one year from the date hereof, or such further time as the City Council may grant. 17. That Conditions Nos. 6, 7, 8, 9, 10, 11, 12, 13, 14 and 15, above ~entioned, shall be complied with prior to final building and zoning inspections.
