RESOLUTION NO. 70R-373 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2182 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from A. H. Shi ke Incor orated of certain real prope ty situated in the City of Anaheim, County of Orange, State of California, described as follows: Vineyard Lot ~5 and Lot 26, 27, and 28 as shown in Book 3, pages 109-110, Miscellaneous Records Los Angeles County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on Ju,e 15. 1970 , notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC 70-101 dP-nyinq Variance No. 2182 ; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denyinq said variance, and said appeal was set for public hearing on Ju1v 28 19 70 ,at 1:30 o'clock PoM. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- permitting the establishment of a passenger car and truck sales facility on the property hereinbefore described with a waiver of the following Anaheim Municipal Code requirement or limitation: Section 18.44.p10 Permitted uses in the C-2 Zone. (The proposed use is not a permitted C-2 use). That said variance be granted subject to the fo11owing(conditions; 1. That the Qwner(s) of subject property shall deed to the City of Anaheim a strip of land 10 feet in width from the centerline of the alley for alley-widening purposes. 2. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 3. That all air-conditioning facilities shall be properly shielded from view. 4. That any lighting shall be tect the parking area lighting proposed shall be down- Of a maximum height of 6 feet, which lighting directed away from the property lines to pro- residential integrity of the area. 5. That subj~ct property shall be developed substantially in accord_nee with plans and specifications on file with the City of Anaheim marked Exhibit No.1, Revision No.1, to be implemented within a period of one year. 6. That Condition No.1, above mentioned, shall be complied with priof to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from the date hereof, whichever occurs first, or such further time as the City Council may grant. 7. That Conditions Nos. 2, 3, 4, and 5, above mentioned, shall be complied with prior to final building and zoning inspections. 8. All junked tires to be in an enclosed area not visible from Linccln Avenue. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 28th day of July, 1970.
