70R-324 RESOLUTION NO. 70R-324 A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM dENYING VARIANCE NO. 2176. Excepting therefrom any portion thereof lying within Riverside Freeway, as described in an instrument recorded June 11, 1964 in Book No. 7083, page 32, Official Records, and other instruments of record deeded to the State of California for freeway purposes. AND WHE~AS, the City Planning Commission did hold a public hearing at ~he City Hall in the City of Anaheim on June 15, 1970, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspec- tion, investigatiort and studies made by itself and in its behalf, -2- . IT .'" and after due cons!deration of all evidence and reports offered at said hearing, did adopt Resolution No. PC 70-97 denying said variance; and WHEREAS, thereafter within twenty-two (22) days from the date of the adqption of said resolution. the City Council did elect J upon it~ own motion. to review the action taken by the City Planning Comm~ssion in denying said variance and did set a public hearing the*eon to be held on the 30th day of June, 1970, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other iproperty in the same vicinity and zone and denied the subject property. 2. It appea~s that the subject property can be adequate1y developed and used under the present zone. NOW. THEijEFORE J BE IT RESOLVED by the City Council of the City of Anaheina that the action of the City Planning Commission in deny:ffng said variance bet and the same is hereby, sustained.
