70R-316 RESOLUTION NO. 70R-3l6 A RESOLUTlON OF THE CITY COUNCIL OF THE CITY OF ANAHEI~ DENYING CONDITIONAL USE PERMIT NO. 1157. WHEREAS, ~he City planning Commission of the City of Anaheim did receiveja request for a conditional use permit from Jerry Hansen, as ag~nt for Dr. Irving Moskowitz, owner, to establish a 99-bedt one-story general hospital on the following described property. PARCEL 1: That portion of Lot 26 of Anaheim Extension, in the City of Anaheimt Co~nty of Orange, State of Californiat as shown on a map of survey made by William Hamel, a copy of which is filed. in the office of the county recorder of said Orange Co~ntYt in book 3. page 163, et seq., entitled "Los Ange les Cpunty Maps, If des cribed as follows: Beginning at a point on the easterly line of said Lot 26, northerly 503.~9 feet from the southeast corner of said lot, said sout~east corner being for the purpose of this description at the intersection of the center line of Ball Road with the center line of Los Angeles Street; thence northerly 84 f~et along said easterly line; thence westerly to a point on the westerly line of said lot being on the center line of Lemon Street, northerly 415.89 feet thereon from the south~rly line of said lot; thence southerly 84 feet along said westerly line to a point which is northerly 331.89 feet thereon from the southerly line of said lot; thence easterly 612.49 feet to the point of beginning. EXCEPT all oil. gas and other hydrocarbon substances and minerals in and under said land below 500 feet from the sur- face thereof, but without the right to enter upon any part of said land f~r the purpose of recovering said substances, as reserved by Dossn I. Wagner, a widow, in deed dated April 1, 1960 and recorded May 4, 1960 in book 5226, page 211 of Official Records. PARCEL 2: That portion ot Lot 26 of Anaheim Extension in the City of Anaheim, County of Orange, State of California, as per map of survey made by William Hamel, a copy of which is filed in the office of the county recorder of said Orange County, in book 3, page 163, et seqq entitled "Los Angeles County Maps," described as follows: Beginning at a point on the easterly line of said Lot 26, northerly 587.19 feet from the southeast corner of said lot, said southeast corner being for the purpose of this descrip- tion at the intersection of the center line of Ball Road with the center lin~ of Los Angeles Street; thence northerly 284.66 feet along said easterly line; thence westerly to a point on the westerly l1ne of said lot, being on the center line of Lemon Street, northerly 700.55 feet thereon from the southerly line of said lot; thence southerly 284.66 feet along said westerly line to a point which is northerly 415.89 feet thereon from the southerly line of said lot; thence easterly 612.49 feet to. the point of beginning. -1- ..._......."'.....c..........._.<-o_..c .--+--- AND WHE~AS, the City Planning Commission did hold a pUblic hearing at ~he City Hall in the City of Anaheim upon said request on Februaru 25, 1970, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter ~8.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studi,s made by itself and in its behalf and after due consideration ()f all evidence and reports offered at said hearing, did adopt its Resolution No. PC 70-27 granting Conditional Use Pe~mit No. 1157; and WHEREAS, thereafter, within twenty-two (22) days from the date of the ad~ption of said resolution.. the City Council did elect, upon its own motion, to review the action of the City Planning Commissio~ in granting said conditional use permit and did thereupon fix ~he 7th day of April.. 1970, and continued to the 30th day of June, ~970, for decision, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditinal use permit. and notices of such pUblic hearin~ were duly given as required by law and the provisions of Titl~ 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, !at the time and place fixed for said pUblic hearing, the City qouncil did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 1157 should be denied. NOW, THERf:FORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting Conditional Use Permit No. 1157 be, and the same is hereby reversed, and that the request of Jerry Hansen as agent for Dr. Irving Moskowitz to establish a 99-bed, one-story general hospital is. hereby denied.
