70R-289 - RESOLUTION NO. 70R-289____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS LAKEVIEW-LA PALMA ANNEXATION. WHEREAS, the City of Anaheim did on the lOth day of March, 1970, submit to the Local Agency Formation Commission proof of written consent signed by all of the owners of the land within the territory proposed to be annexed to the City of Anaheim; and WHEREAS, said Local Agency Formation Commission authorized the City of Anaheim to annex said territory without notice and hearing and without an election pursuant to the authority vested in said Commission by Section 54797.1 of the Government Code; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabited territory. That said consent contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council of the City of Anaheim is authorized to approve said annexation by resolution without notice and hearing pursuant to the approval of said Local Agency Formation Commission and Section 54797.1 of the Government Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim finds: That the City of Anaheim did on the 10th day of March, 1970, submit to the Local Agency Formation Commission proof of written consent signed by all of the owners of the land within the territory proposed to be annexed to the City of Anaheim. That said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabited territory. That said consent signed by all of the owners of land within the territory proposed to be annexed contained a description of said territory in words and figures as hereinafter in this resolution described. That the City of Anaheim filed said request to annex said territory, containing the specific boundaries of the terri- tory to be annexed, with the Local Agency Formation Commission and said Local Agency Formation Commission approved said annexa- tion request of the City of Anaheim pursuant to Section 54797.1 of the Government Code. ,.............-^ That on the 13th day of May, 1970, the Local Agency Formation Commission duly adopted Resolution No. 70-73 in which said Commission authorized the City of Anaheim to annex said territory in accordance with Section 54797.1 of the Government Code and further approved such annexation of said territory with- out notice of hearing. -1- ..dl{.c, That the Local Agency Formation Commission further, by resolution, authorized the City Council of the City of Anaheim to annex said territory without notice or hearing by the City Council and without the requirement that an election be held by the City on the question of said Annexation. BE IT FURTHER RESOLVED that the Annexation of the territory included within the boundaries of the LAKEVIEW-LA PALMA ANNEXATION, more particularly described as follows, to wit: . -2- REVISED LAKEVIEW - LA PALMA ANNEXATION TO THE CITY OF ANAHEIM That parcel of land located in the County of Orange, State of California, described as follows: Beginning at a point in the existing city limit line of the City of Anaheim as established by the Lakeview - Orangethorpe An- nexation passed by Resolution No. 69R-240, April 22, 1969, filed with the Secretary of State April 26, 1969 and recorded May 1, 1969, records of Orange County California, said point of beginning being distant from the centerline intersection of Orangethorpe and Taylor Street, now known as Lakeview Avenue, the following courses and distances, South 00 48' 16" East, 447 feet, more or less, South 820 27' 46" East, 690 feet as said intersection is shown on a Record of Surveys Map filed in Book 37, page 25, records of Orange County California: thence Following along a portion of the existing city limit line of the City of Anaheim as established by the said Lakeview - Orange- thorpe Annexation, being a portion of the southerly line of the land described in deed recorded August 12, 1964 in Book 7175, pages 493 through 495, records of Orange County California the following courses and distances, South 820 27' 46" East, 338.92 feet to the beginning of a tangent curve concave northwesterly and having a radius of 333 feet: thence northeasterly along said curve through a central angle of 110 54' 10" an arc distance of 69.18 feet to the point of intersection with the northerly line of the land described in deed recorded December 6, 1957 in Book 4125, page 554, records of Orange County California, a radial line bear- ing South 40 21' 56" East, passes through said point of intersection: thence South 820 16' 20" East, 290.09 feet to an intersection with the westerly line of the land described in deed recorded June 27, 1957 in Book 3955, page 279, records of Orange County California, said point of intersection being a point in the existing city limit line of the City of Anaheim as established by the Northeast Annex- ation No. 3 to the City of Anaheim passed by Ordinance No. 1542, January 17, 1961, filed with the Secretary of State July 10, 1964 and recorded July 13, 1964, records of Orange County California: thence South 80 03' 40" West, 1,445 feet, more or less, leaving the existing city limit line of the City of Anaheim as established by said Lakeview - Orangethorpe Annexation and following along a portion of the existing city limit line of the City of Anaheim, as established by said Northeast Annexation No.3, being a portion of -3- "'~""'-"'.~.-"-'--'---'~_'''''''''''''''_^+",,,,--,,,,i,- Revised Lakeview - La Palma Annexation To The City of Anaheim the west line of the land described in the last mentioned deed to an intersection with the northerly line of the land described in deed recorded May 22, 1951 in Book 2191, page 307, records of Orange County California~ thence North 820 16' 20" West, 588 feet, more or less, following along a portion of the last mentioned existing City of Anaheim city limit line being a portion of the northerly line of the land described in the last mentioned deed to an intersection with the westerly line of the land described in the deed recorded January 15, 1945 in Book 1298, page 178, records of Orange County California~ thence North 30 41' 57" West, 384 feet, more or less, leaving the said existing city limit line of the City of Anaheim, and following along the westerly line of the land described in the last mentioned deed and the northerly prolongation thereof, to an intersection with the southerly line of the land described in deed recorded April 19, 1967 in Book 8228, page 947, records of Orange County California~ thence North 820 16' 20" West, 609 feet, more or less, along the southerly line of the land described in the last mentioned deed to an intersection with the centerline of Taylor Street, now known as Lakeview Avenue~ thence North 00 48' 16" West, 198 feet, more or less, along the last mentioned centerline to an intersection with the northerly line of the land described in the deed recorded April 19, 1967 in Book 8228, page 947, records of Orange County California~ thence South 820 16' 20" East, 625 feet, more or less, along the northerly line of the land described in the last mentioned deed to an intersection with the westerly line of the land described in deed recorded August 25, 1949, in Book 1893, page 188, records of Orange County California; thence North 30 41' 57" West, 860 feet, more or less, along a portion of the westerly line of the land described in the last mentioned deed and the northerly prolongation thereof, to the point of begin- ning. -4- - is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the LAKEVIEW - LA PALMA ANNEXATION to the City of Anaheim. BE IT FURTHER RESOLVED that from and after the date of the adoption of this resolution and the filing of a certi- fied copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim contracted prior to or existing at the time of such annexation pursuant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this resolution.
