70R-285 -, ~-~ Rf;SOLUTION NO. 70R-285 A RESOLUTIO~ OF THE CITY COUNCIL OF THE CITY OF AN~EIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATI~G TO ZONING SHOULD BE AMENDED AND THAT Tl$ BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, t~ City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 6~-70-53 to consider an amendment to Title 18 of t e Anahaim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, w~thin a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said he~ring, and a recommendation that the pro- posed amendment be aqopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, ugon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 9th day of . JUJ;le , 19 7.j as the time, and the City Council Chambers in the City Ha 1 of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Coumcil did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 69-70-53 -1- Parcell: That portion of the south half of lot 13 of Helen and Lynch's Subdivision off the west half of Section 16, Township 4 South, Range 10 West. San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in book 442 page 18 of Deeds, records of said Orange County, described as follows: Beginning at the southwest corner of said south half; thence North 00 18' 00" West, along the west line of said lot 13, 240.19 feet to the southwest corner of the land des cribed in paragraph No.1 of the Judgment No. 65491, recorded June 8, 1955 in book 3096 page 227, Official Records of said Orange County; thence. along the boundary of said land, North 890 11' 11" East 166.00 feet and North 00 18' 00" West 90.00 feet to the north line of said south half; thence North 890 11' 11" East, along said north line 68.37 feet to the northwest corner of Tract No. 6451, as shown on a map recorded in book 238 pages 12 and 13 of Miscellaneous Maps, records of said Orange County; thence along the boundary of said tract the following courses and distances: South 00 15' 53" East 241.74 feet to the beginning of a tangent curve concave easterly having a radius of 127.00 feet; thence southerly along said curve, through a central angle of 220 22' 43", an arc distance of 49.60 feet to a point in a reverse curve concave westerly having a radius of 73.00 feet; thence southerly along said curve, through a central angle of 360 45' 42", an arc dis- tance of 46.84 feet; thence South 00 18' 00" East 0.40 feet to the south line of said south half; thence leaVing said boundary, along said south line. South 890 16' 28" West 270.01 feet to the point of beginning. Parcel 2: Beginning at the northwest corner of south half of the west half of the south half of the southwest quarter of the north- west quarter of Section 16, Township 4 South, Range 10 West, San Bernardino Base Meridian, estimated to contain 10 acres, being lot 13 of Helen and LynCh'S Subdivision of the west half of Section 16, Township 4 South Range 10 West, as shown on a map thereof recorded in book 442 page 158 of Deeds, records of Los Angeles County, California; thence easterly along the north line of said south half 166 feet to a point; thence southerly parallel to the west line of said south half 90 feet to a point; thence westerly parallel to the northerly line of said south half 166 feet to a point in the westerly line of said south half; thence northerly along the west line of said south half 90 feet to the point of beginning. be excluded from R-A. Agricultural Zone. and incorporated in C-l, General Commercial Zone, upon the following conditions: ."'""'-." 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Euclid Street, for street lighting purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15<1: per front foot along Euclid Street, for tree planting purposes. 3. That vehicular and pedestrian access rights to Alvy Street shall be dedicated to the City of Anaheim. -2- 4. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That a p~cel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 7. That subject property shall be served by underground utilities. 8. That all air-conditioning facilities shall be properly shielded from view. 9. That park1ng area lighting proposed shall be down- lighting of a maximum height of 6-feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 10. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with 6-inch high, concrete curbs, and concrete wheel stops shall be provided for parking spaces as required by the Develop- ment Services Department. 11. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with condi- tions pertaining to such parcel, provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. 12. That tree screen landscaping at 20-foot centers shall be planted in a 6-foot planting strip along the easterly boundary of subject property, as stipulated to by the petitioner. 13. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1, 2, and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within l80 days ~rom the date hereo~ or such further time as the City Council may grant. 14. That Conditions Nos. 4, 5, 6, 7, 8, 9, 10, 11, and 12, above mentioned, shall be complied with prior to final building and zoning inspections. -3- - -- BE IT FUR~ER RESOLVED that the City Attorney be, and he is hereby authori~ed and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein foan4 and determined to be necessary and proper.
