Al'JD \vHEP~AS, the City Planning Commission did hold a public hearing at the City hall in the City of Anaheim upon said petition on April ~O, 1970, notice of v~lich said public hearing was duly given as tequired by law and the provisions of Title 18, Chapter 18.76 of tJ.j:Le Anaheim l1unicipal Code; and WHEllliAS, .said City Planning Con~ission, after due inspection, investigation and studies made by itself and in its behalf. and after ~ue consideration of all evidence and reports offered at said he.ring, did adopt Resolution No. PC70-64, denying Variance n<p. 2172; and WHEIillAS, . thereafter, wi thin twenty.-two (22) days from the date of the ad~ption of said resolution, a written appeal was filed with the City Council of L~e City of Anaheim protesting the action of the City 'Planning Commission denying said variance, and said appeal was set for public hearing on 19 May, 1970, at 7:00 o'clock P.li. at the City Hall in the City of Anaheim, and notice of such public heaJting was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code f and WHEREAS, after due investigation and studies made by itself and in its behalf; and after due consideration of all the evidence and repor~s offered at said hearing, the City Council does find and dete~mine tl1at: 1. There are exceptional or extraordinary circum- stanqesor conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for ~~e preser- vati~n and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be n~aterria.lly detrimental to the public welfare or inju~ious to tile property or improvements in such vicinity and zone in which tile property is located. -2- ,~~.- 4. Th~t the granting of such variance will not ad~ersely affect the comprehensive general zoning plaJn. NOW, 'rfREFORE' BE IT RESOLVED by the City Council of the City of Anaheim . at a conditional zoning variance be, and the same is hereby grante . permitting the construction of a 60-foot 168.- square foot displ y area free-standing sign on the hereinbefore property subject to ele following conditions: 1. Tha~ adequate clearance of existing electrical lines shaRI be provided as required by ~1e Electrical Div~sionr Department of Public Utilities, and the Sta~e of California G.O. 95. 2. That subject property shall be developed substantially in accordance with plans and specifications on file wi~ th~ City of Anaheim, marked Exhibit No.1. The Citf Council hereby reserves tne right to revoke such variance permit f~r good cause or failure of said owner, his heirs, successors or assigns; to corr~ly Witil the An~1eim Municipal Code and regulations axj1d the conditions herein. Said variance is granted for the term presQ:ribed oy the Anaheim IViunicipal Code unless other- wise specified herein.
