70R-178 fmSOLUTION NO. 70R- 178 A RESOLUTiN OF THE CITY COUNCIL OF THE CITY OF ANAHEI AMENDING RESOLUTION NO. 63R-9l0 AND SUPE EDING RESOLUTION NO. 69R-643, AMEND- ING PERSO EL RULE NO. 6 - PREMIUM PAY. BE IT REStLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that Personn 1 Rule No. 6 - Premium Pay is hereby amended to read as f llows: RULE 6 PREMIUM P~Y Section 6.0 An ~lOyee in the classified service who performs authorized work in e cess of his regular work week, work day, or shift shall be compe sated for such overtime work at the rate of one-and-one-half ti~s his regular hourly rate of pay. 6.01 Overtime $hall be calculated to the nearest one-quarter hour of o~ertime worked, except any overtime of less than 1/2 ~our duration shall be calculated to the nearest 1/2 hour. 6.02 All over~ime must be authorized by the appropriate departme~ head and approved by the City Manager. 6.03 Compensatpry time off at the overtime rate may be authoriz~ by the appropriate department head in lieu of ~ay on the basis of the best interests of his department and the City of Anaheim; but, the employee shall have the option of being paid in cash for any dvertime work performed, and shall have the option of accruing up to a maximum of forty-eight (48) hours co~pensatory time. An employee shall be com- pensatedin cash at his current rate of pay for any accrued compensatory time in excess of forty-eight (48) hours as of the last day of each calendar year. Upon te~ination, an employee shall be compensated in cash at his current rate of pay for any accrued com- pensatory time. 6.04 Certain job classes in the classified services shall be exempt f~om the above overtime provisions upon the recomrnenqation of the Personnel Director and approval of the city Council. These job classes shall be designat~d in the Resolution establishing rates for job clas$es by an "X" before schedule numbers. Com- pensatory time off (at the rate of straight time) for overtime worked by employees in these job classes may be authorized and administered by the appropriate department head. ""~." 6.05 Notwithstanding the above overtime provisions, there shall be no compensation for time spent in attending meetings of any kind which are for the purpose of educatio~ or training; and, Police Lieutenants shall be compe~sated at their regular hourly rate of pay for required court appearances during off-duty hours. -1- Section 6.1 An employee assigned to standby duty for purposes of being on call to ~andle emergency situations arising at times other than during not-mal working hours shall be guaranteed two (2) hours of pay at his regular rate of pay for each calendar day of such standby duty ~ Section 6.2 Call-put compensation shall be in accordance with the following provis~ons: 6.21 When an ~ployee is called out for emergency work, he shall ~e paid at the rate of one-and-one-half times his! regular rate of pay for such emergency work. 6.22 All emerg~ncy call-out time shall be calculated to the nearest o~e-quarter hour of time worked. 6.23 A minimum of two (2) hours (including travel time) of pay at th~ rate of one-and-one-half times the employee's regular rrte of pay shall be guaranteed for each emer- gency cal. -out. 6.231 Employees subpoenaed to appear during off-duty ho~rs as a prosecution witness for court matters wi~hin the scope of their employment and who repeive such subpoenas after 5.00 P.M. the calendar day prior to the date of court appear- ance shall receive overtime compensation accord- ing to emergency call-out provisions. 6.24 A minimum. of two (2) hours pay at the rate of one-and- one-half times the employee's regular rate of pay shall be guaranteed for planned overtime, except when such overtime pccurs immediately before or after a regular work period. 6.241 Employees subpoenaed to appear during off-duty ho~s as a prosecution witness for court matters within the scope of their employment and who receive such subpoenas before 5:00 P.M. the cal- enijar day prior to the date of court appearance shall receive overtime compensation according to the planned overtime provisions. 6.25 Forty-five minutes time shall be added to the time worked to compensate the employee for travel time in- curred for each emergency call-out. Section 6.3 All e~ght hour periods, regularly scheduled to begin at 3:00 P.M. or ther~after, but before 3:00 A.M., shall be designa- ted as night shift. 6.31 A premium of 5.0% of the employee's regular hourly rate of pay sh~ll be paid for work performed in the night shift. 6.32 A premium of 5.0% of the employee's regular hourly rate of pay sh~ll be paid for each hour worked in his regular rate of p~y between 3:00 A.M. and 6:00 A.M. 6.33 When a sh~ft premium is applicable to time worked at the overt~e rate of pay, the overtime rate shall be applie~ to the applicable shift premium. -2- """-,_....--,...".. 6.34 Shift pr~ium shall be payable only for hours actually worked anq shall not be paid for nonwork time, such as vacati~ns, holidays, sick leave, etc. 6.35 Employees iin the following job classes shall be exempt from the arovisions of Section 6.3 through 6.34: ~olice Lieutenant ~olice Sergeant Bolice Patrolman ~olicewoman hief Distribution olygraph Examiner Operator Section 6.4 Tempo~ary upgrading shall be defined as the tempo- rary assignment of aq employee to work in a job classification rated higher than his regular classification. 6.41 Employees jtemporarily upgraded to certain classifica- tions sha~l receive a five per cent (5%) pay differen- tial eachJhour worked in the higher classification during normal wo~king hours if they are assigned to work in the higher cl~ssification for a minimum of two (2) hours of each day. Employees temporarily upgraded to any of these classific~tions shall receive a five per cent (5%) pay different~al for all time worked in the higher classi- fication ~uring other than normal working hours. These job class~fications shall be designated in the Resolu- tion esta~lishing rates for job classes by a "u" before schedule numbers. 6.42 Employees temporarily upgraded to the following classifi- cations s~all receive a five per cent (5%) pay differ- ential for all time worked in the higher classification during no~al working hours if they are assigned to work in the hi~er classification for a period of one com- plete work shift (8 working hours) or longer. Employees temporaril~ upgraded to any of these classifications shall rec~ive a five per cent (5%) pay differential for all time ~orked in the higher classification during other than normal working hours. 'ire Battalion Chief tire Captain :!fire Engineer Upgrade ~. a vacant position shall be limited to six months, cept in cases of extended sick leave or a leave of sence. 6.5 Short shift cha~ges as defined herein shall be compensated at the rate of one-and-qne half the employee's regular rate of pay. 6.51 The first :work day on a new schedule after transfer from one sched~le of working days to another without notifi- cation of isuch transfer at least twenty-four (24) hours in advanc$ of the starting time of the new schedule. 6.52 The first .shift after transfer from one eight (8) hour working sqift to another without notification of such transfer ~t least twenty-four (24) hours in advance of the start~ng time of the new shift. 6.53 Whenever ~equired to transfer from one schedule of working d~ys to another with but eight (8) hours off between sHifts more than once in a work week. 6.54 No overti~e compensation shall be paid for any hours worked ona second shift in any twenty-four (24) hour period, wHich hours are worked as a result of the regular sHift rotation or which hours are worked as a result of shift changes or changes in days off mutually agreed upon by employees for their convenience.
