70R-167 RESOLUTION NO. 70R-167 A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF ANAHE]M GRANTING VARIANCE NO. 2139. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from John and Anne Krajacic, owne~s, of certain real property situated in the City of Anaheim, Co~nty of Orange, State of California, described as follows: Parcell: The South 222.00 feet of the North 288.00 feet of the East 108.00 feet (measured along the North- erly and Easterly lines) of the Northwest quarter of the Northwest quarter of the Northeast quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as said section is shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said county. Parcel 2: The East 1.00 acre of that portion of the Northwest quarter of the Northwest quarter of the Northeast qua~ter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as said section is shown on a Map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said county, lying Southerly of the North 288.00 feet thereof, said 288.00 feet being measured along the Easterly line thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on November 26, 1969, notice of which said pUblic hear- ing was duly given as required by law and the provisions of Title 18 Chapter 18.76 of the Anaheim Municipal Code, and did adopt Resolution No. PC69235 approving Variance No. 2139; and WHEREAS, petitioner appealed to the City Planning Com- mission for an amendment to the conditions of said Resolution No. PC69-235 whereupon a pUblic hearing was held on February 25, 1970, notice of which public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Muni- cipal Code; and WHEREAS, said City Planning Commission, after due inspection, investig~tion and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC70-20 amending Resolution No. PC69-235; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution petitioner appealed to the City Council for an amendment to the conditions of said variance as approved by the Planning Commission whereupon a pUblic hearing was held on the 31st day of March, 1970, at 1:30 o'clock P.M. and continued tQ April 7, 1970, at 1:30 P.M. for decision only in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provi- sions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- '-~~.,.._<.",''';'' .....--- WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reporta offered at said hearing, the City Council does find and determine that: 1. There ar$ exceptional or extraordinary circum- stances ~r conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That sucm a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the pUblic welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance approving Variance 2139, subj~ct to conditions as amended, be, and the same is hereby granted, permitting the storage of trailers, campers and boats on the rear of R-A Zoned property, hereinbefore described said amended conditions reading as follows: 1. That all engineering requirements of the City of Anaheim along Lincoln Avenue, including preparation of improvement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lincoln Avenue, for street lighting purposes. 3. That the owners of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Lincoln Avenue, for tree planting purposes. 4. That trash storage areas shall be provided in accor- dance with approved plans on file with the Office of the Director of Public Works. 5. That fire hydrants shall be installed as required and detertmined to be necessary by the Chief of the Fire Department. -2- '-"""'.c,__._ 'II , -~ 9. 10. 11. 6. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 7. That any parking area lighting proposed shall be down-llg4ting of a maximum height of 6-feet, which lighting .shall be directed away from the property lines to 'protect the residential integrity of the area. 8. That tre~ screen landscaping shall be planted and maintained along the east, south and west property lines of the trailer, camper and boat storage area, adjacent to the eXisting 6-foot masonry wall. That drives and travel ways shall be blacktopped, and that the area where travel trailers and boats are to be stored shall be treated with a sodium com- pound to eliminate the weeds and dust from affect- ing adjoining property owners. That Conditions Nos. 1 and 5 shall be cQmplied with within six (6) months from the date of this resolu- tion. That Cond~tions Nos. 2, 3, 4, 6, 7, 8, and 9, above- mentioned shall be complied with within a period of three years from date of the original resolution, namely November 17, 1969; provided that only 48 cam- pers, trailers and boats are stored on the property; that if more than 48 vehicles are proposed to be stored said three-year time limit shall become null and void and the petitioners shall comply with the aforement1oned conditions immediately; and further provided, that upon the expiration of said three years (November 16, 1972), if the conditions have not been complied with, operation of the storage of vehicles shall cease and desist within 10 days of said e~piration, and all vehicles removed from the premises. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Muni- cipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 7th day of April, 1970.
