70R-166 RESOLUTION NO. 70R-166 ,- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2158 WHEREAS, tije City Planning Commission of the City of Anaheim did receive ~ petition for zoning variance from Joyce Landford 0 ner 1158 Hazelwood Anaheim of certain real proprty situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot No. 101 of Tract No. 1247, in the City of IAnaheim, County of Orange, State o~ California AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on Mar~ 9. 1970 , notice of which said public hearing was duly gi . n as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, slaid Ci ty Planning Commission, after due inspection, investiglation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC70-36 denying Variance No. 2158 , ; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on April 7 , 19 70 , at 1:30 o'clock PoM. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- -..-..-..,...._-, ""..,..... I'JHEREAS, after due investigation and studies made by itself and in its behalf, and after due consIderation of all the evidence and reports offered at said hearing, the City Counc~l does find and determine that: 1. There are e~ceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a var1ance is necessary for the preser- vation and enjoyment of a substantial property right posse~sed by other property in the same viC1nity and zone and denied to the property in question. 3. That the g~anting of such variance will not be materially detrimental to the public welfare or injurious tp the property or improvements in such vicinity and zone in which the property is located 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREF10RE, BE IT RESOLVED by the City Counc:d of the city of Anaheim that a conditional zoning variance be, and the same is hereby g~anted permitting the continued operation of a beauty shop in the attached two-car garage on R-l (single family residential zone) property with waivers of the following Anaheim Municipal Code requirements and subject to the conditions hereinafter set forth: Section 18.24.010(1) Section 18.24.030(5) Permitted uses in the R-l Zone Required two-car garage That this variance is granted subject to the following conditions: 1. Operation to remain a one-operator shop, not to exceed three customers being served at one time. 2. No adve~tising on the premises. 3. No commercial listing in the telephone directory. 4. All debris from the operation which accumulates on the property be properly placed in trash receptacles. 5. That subject property be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No.1. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, her heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Ananeim Municipal Code unless otherwise specified herein. -2- THE FOREGOI~.G RESOLUTION is ~proved and signed by me 7th day of .
