70R-138 RESOLUTION NO. 70R-138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA1IEIM GRANTING CONDITIONAL USE PERMIT NO. 1147 , IN PART. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from Jay Kingry of Pacific Outdoor Advertising Company as Agent for Louis B. Minter, 9808 Wilshire Boulevard, Beverly Hills, California, Owner, to permit a billboard with waivers of the Anaheim Municipal Code Sections on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Beginning at a point on the westerly line of the southwest quarter of said section 8, North 00 16' 10" West 194.00 feet from the southwest corner of section 8; thence South 890 31' 00" East, parallel with the southerly line of said section 8, to the westerly line of the land described in the deed to stanley Krell, et al., recorded March 15, 1956, in book 3438, page 424, Official Records; thence northerly 69.00 feet along said westerly line to the easterly pro- longation of the southerly line of the land described in the deed to John A. Crawford et ux., recorded February 25, 1955, in book 2973, page 471, Official Records; thence westerly along said southerly line and its easterly pro- longation to the westerly line of said section 8; thence South 000 16' 10" East 69.00 feet to the point of beginning. ,- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City oi Anaheim upon , said application on Januar~ 12 , 19 70 , notices of ' which said public hearing were uly given as required by law and the provisions of Title 18, Chapter 18.76 of the ~naheim MUnicipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution ~o. PC 70-3 Series qrantinq Conditional Use Permit No. 1147. in part and -1- WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said conditional use permit and said appeal was set for public hearing on ~ebruary 17 , 19 70 , at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and continued to March 24, 1970, for decision. WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in granting in gartsaid conditional use permit be, and the same is hereby su~tained , and that Conditional Use Permit No. 1147 be, and the same is hereby, granted permitting a billboard on the above described property subject to the follow- ing conditions and waiver of the following Anaheim Municipal Code requirements: Section 18.63.030 Distance from a residential structure. (Minimum of 75 feet required; 70 feet proposed). 1. That adequate clearance of existing electrical lines shall be provided as required by the Electrical Division, Department of Public utilities, and the State of Cali- fornia G.O. 95, prior to final building inspection. 2. That subject property shall be developed in accordance with the provisions of the Billboard Ordinance; pro- vided, however, that said billboard may be located 70 feet from a residential structure as granted by the above waiver. -2- _--.-~"..""~,,,.,. ,...."",.-. -".'."'- 3. Applicant shall dedicate 20 feet of land on the above described property for street widening purposes. The City CQunci1 hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
