RESOLUTION NO. 70R- 132
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF UTILITIES AGREEMENT NO.
7Ut-4307 WITH THE STATE OF CALIFORNIA. FOR
ADJUSTMENT OF SEWER MANHOLES TO GRADE IN
CONNECTION WITH THE IMPROVEMENT OF BEACH
BOULEVARD (ROAD 07-0RA-39 8.7/l5.2).

WHEREAS. !the improvement of Beach Boulevard (Road
07-0ra-39 8.7/l5.2) ~etween Garden Grove Boulevard and Man-
chester Boulevard, requires the adjustment of sewer manholes
to grade; and
WHEREAS, the cost of said work is to be borne by the
City in accordance with Section 673 of Statutes requiring that
relocation or removal of any encroachment installed in a State
highway shall be at 100% of owner's expense; and
WHEREAS, the State of California, Department of Public
Works, Division of Highways, has submitted to the City, Utilities
Agreement No. 7U:t-4ao7 to be made and entered into by and between
the City and the State for adjustment of sewer ~anholes to grade
in connection with the improvement of Beach Boulevard, said work
to be performed by the State at an estimated cost to City of
$2,500.00, upon the terms and conditions and in accordance with
the procedure set forth in said agreement; and
WHEREAS, the City Council finds that it would be for
the benefit and bes~ interest of the City to enter into said
agreement with the S~ate of California.
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of
the City of Anaheim that Utilities Agreement No. 7Ut-4307 this
day submitted to the City Council by the State of California,
Department of Public Works, Division of Highways, to be made and
entered into by and between the City and the State for adjust-
ment of sewer manholes to grade in connection with the improve-
ment of Beach Boulevard, at an estimated cost to the City of
$2,500.00, upon the terms and conditions and in accordance with
the procedure set forth in said agreement, be and the same is
hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of March , 19 70.
