RESOLUTION NO. 70R- 129
A RESOLUT]ON OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER FO~ THE FURNISHING OF 29 TRAFFIC SIGNAL
CONTROLLERS FOR VARIOUS INTERSECTIONS OF THE
CITY OF ANAHEU1.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published qnd circulated in the City of Anaheim, to wit:
The Anaheim Bulletin, on February 19th and February 26th, 1970,
a notice inviting sealed proposals for the furnishing to the City
of Anaheim of 29 Traffic Signal Controllers as set forth in the
specifications on file in the Office of the City Clerk or City
Engineer; and
WHEREAS, said notice did provide that said materials
for said traffic signal controllers shall be in accordance with
specifications on file in the Office of the City Clerk or City
Engineer; and
WHEREAS, such notice inviting proposals for said traffic
signal controllers did provide that said sealed proposals would
be received by the City of Anaheim at the Office of the City Clerk
of said City up to the hour of 2:00 o'clock P.M. on March 5, 1970,
for various intersections of the City of Anaheim; and
WHEREAS, the City Clerk of the City of Anaheim did
receive a sealed proposal prior to 2:00 P.M. on March 5, 1970,
for the furnishing of said traffic signal controllers, which
proposal was opened on said date in public, in the City Council
Chambers in the City Hall, in the City of Anaheim by the City
Clerk and the City Engineer, and duly tabulated by the City
Engineer and the result thereof reported to the City Council at
its next regular meeting, for action thereon by said City Council.
That a sealed proposal was received from the following corporation
in the amount set forth:

FISCHER AND PORTER COMPANY
$159,424.00
AND WHEREAS, the City Council does find that the sealed
proposal of FISCHER and PORTER COMPANY, 3756 Grand Avenue, Oakland,
California 94610, is the lowest responsible bid for the furnishing
of traffic signal controllers for various intersections in the City
of Anaheim as specified in the notice inviting sealed proposals
and in accordance with the specifications therefor, and that said
proposal of Fischer and Porter Company should be accepted and a
contract awarded to said company for furnishing of said traffic
signal controllers for various intersections in the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said proposal submitted by Fischer and
Porter Company for the furnishing of 29 traffic signal controllers
for various intersections in the City of Anaheim, as specified in
the notice inviting sealed proposals therefor and in accordance
with and conformity to the specifications on file in the Office of
the City Clerk be, and the same is hereby, accepted and that a

contract for the furnishing of said traffic signal controllers be,
and the same is hereby awarded to said Fischer and Porter Company;
and
BE IT FURTHER RESOLVED that the award of a contract to
said Fischer and Porter Company is declared to be for the approxi-
mate quantities set iforth in the notice inviting sealed proposals
and that the actual 'amounts required by the City may be substan-
tially more or less than these amounts; and
BE IT FURTHER RESOLVED that said Fischer and Porter
Company be, and it is hereby required to execute a contract, in
required form satisfactory to the City of Anaheim and upon the
terms and conditions specified in the notice inviting sealed
proposals and the proposal submitted by it, and in accordance
with the specifications for said traffic signal controllers at
the prices set forth in the proposal submitted by it and on file
in the Office of the City Clerk; and
BE IT FURTHER RESOLVED by the City Council of the City
of Anaheim that said bid be, and the same is hereby accepted and
said contract awarded for the prices for said traffic signal
controllers as listed on the accepted proposal on file in the
Office of the City Clerk, for delivery to the Traffic Engineer's
Storage Shed located at Claudina and Santa Ana Streets, Anaheim,
as required by the City of Anaheim after the execution and delivery
of an executed copy of said contract to said Fischer and Porter
Company; and
BE IT FURTHER RESOLVED that the Mayor and City Clerk
of the City of Anaheim be, and they are hereby authorized and
directed to execute for and on behalf of the City of Anaheim with
said Fischer and Porter Company a written contract for the furnish-
ing of said traffic signal controllers in accordance with the
specifications, the notice inviting sealed proposals and the terms
of this resolution, and the contract approved by the City Attorney
of the City of Anaheim; and
BE IT FURTHER RESOLVED that said contract shall contain

a provision that should said Fischer and Porter Company fail or
neglect to furnish said traffic signal controllers in accordance
with said specifications and the sealed proposal submitted by it
and accepted by the City as herein specified, it shall, in addi-
tion to any other penalties provided in the contract documents,
be liable to the City of Anaheim for all loss or damages that the
latter may suffer on account thereof.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of March, 1970.
