A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE EXECUTION OF AN AGREE-
~ffiNT BETWEEN THE CITY AND THE BANK OF M1ERICA
TO SUPERSEDE AN AGREEMENT BETWEEN THE BANK OF
AMERICA AND THE CITY DATED NOVEMBER 30, 1953,
AUTHORIZING THE BANK OF &~ERICA TO PERFORM
ADDITIONAL SERVICES FOR THE CITY IN THE DESTRUC-
TION OF THE CITY OF ANAHEIM COUPONS AND BONDS
TO BE HANDLED BY THE BANK OF AMERICA IN LIEU OF
THE CI'rY.
WHEREAS, the parties hereto did heretofore enter into
an agreement under date of November 30, 1953, whereby bonds and
their attached coupons issued by the City, or Department thereof,
may be presented for payment or collection and be paid at Bank of
America, or at a designated bank or banks in the City of New York,
State of New York, or at a designated bank or banks in the City of
Chicago, State of Illinois; and
WHEREAS, it is the desire of the City to continue to
provide for such presentation and payment of bonds and coupons,
and in addition thereto, to have the Bank of America assume addi-
tional duties to provide accounting and reporting services for
bonds and coupons paid by the Bank of America and also to destroy
such bonds and coupons and provide a destruction certificate
therefor to the City, and the Bank of America is willing to under-
take to perform and discharge the same acts and obligations that
it has performed and, in addition, to undertake to perform the
additional duties desired by the City; and
~~EREAS, a form of agreement dated January 16, 1970, has
this day been submitted to the City Council to be made and entered
into between the Bank of America National Trust and Savings Associ-
ation and the City of Anaheim providing for the above-mentioned
services and cancellation of the previous agreement dated
November 30, 1953; and
WHEREAS, the City Council does find that said agreement
would be for the benefit and best interest of the City and should
be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the agreement this date submitted to the City
Council, dated January 16, 1970, to be made and entered into be-
tween the Bank of America National Trust and Savings Association
and the City of Anaheim providing for cancellation of the agreement
dated November 30, 1953 and for the Bank of America to assume addi-
tional duties, upon the terms and conditions therein set forth, be
and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized to execute said agreement for and
on behalf of the City of Anaheim.
