70R-110 RESOLUTION NO. 70R-IIO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AN~IM GRANTING CONDITIONAL USE PERMIT NO. llq6. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from Mobil Oil Corporation, 11001 Valley Mall, El Monte, California, as agent for Ann H. Prentice, 1101 Reseda, Anaheim, California, owner, to establish a service station within 75 feet of a Residen- tial Zone [Section 18.40.060(c)J on the following described property: That portion of the northwest quarter of the south- east quarter of Section 12, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, Page 10 of Miscellaneous Maps, records of said county, described as follows: Beginning at the intersection of the centerline of Sunkist Street with the centerline of Lincoln Avenue as shown on Map of Tract No. 3438 recorded in Book 132, Pages 7, 8, and 9 of Miscellaneous Maps, records of said county; Thence south 00 10' 16" West, 236.48 feet along said centerline of Sunkist Street; thence at right angles South 890 49' 44" East 171.00 feet; thence North 190 56' 24" East to a point in said cente- rline of Lincoln Avenue; thence North 780 54' 5111 West along said centerline of Lincoln Avenue to the point of beginning. - AND WHEREAS, the City Planning Commission did hold a public bearing at the City Hall in the City of Anaheim upon said application on January 12 , 19 70, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC70-2 ~M~~~X granting Conditicfial Use Permit No. 1146 and -1- ~-"-",__=,,.. tL WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 3rd day of March , 19 70 , as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim MUnicipal Code. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. The size and shape of the site proposed .for the use is adequate to allow the full development of the proposed use in a manner not detrimental- to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 2. 3. 4. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general we.lfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting said conditional use permit be, and the same is hereby sustained, and that Conditional Use Permit No. 1146 be, and the same is hereby granted permitting the establishment of a service s~at~bn w~~~ln ~5 feet of a Residential Zone subject to the followlng condltlons. - s. 1. That this conditional use permit is granted subject to the completion of Reclassification No. 68-69-65. That the Lincoln Avenue right-of-way and street access be approved by the state Division of Highways. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes. 2. 3. -2- 4. That any parking area lighting proposed shall be down-lighting of a maximum height of 6-feet which lighting shall be directed away from the property lines to protect the residential integrity of the area. 5. That subject property shall be developed substantially in accordance with adopted Service Station Minimum Site Development Standards, and the City Council Metal Building Policy. 6. That tree screen landscaping on 20-foot centers shall be installed and maintained adjacent to the required 6-foot masonry wall along the south and east property lines. 7. That Conditions Nos. 2, 3, 4, 5, and 6, above-mentioned shall be complied with prior to final building and zoning inspections. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2, 3 and 4, Revision No.1, which exhibits indicate a "ranch style" structure. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, her heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. The foregoing resolution is approved and signed by me this 3rd day of March, 1970.
