70R-103 RESOLUTION NO. 70R- 103 -- A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF ANAHE~M ORDERING THE VACATION AND ABANDON- MENT OF o:QHAT PORTION OF AN EXISTING ROADWAY, COMMONLY !KNOWN AS ADAMS STREET, AND AN EASE- MENT FOR !ROADWAY PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY. WHEREAS ,the City Council of the City of Anaheim, a Municipal Corporat~on of the State of California, did on the 3rd day of February 1970, pass its Resolution No. 70R-65 entitled "A RESOLUTION OF TItE CITY COUNCIL OF THE CITY OF ANAHEIM DECLAR- ING ITS INTENTION 10 VACATE AND ABANDON A PORTION OF A ROADWAY COMMONLY KNOWN AS ~AMS STREET AND AN EASEMENT FOR ROADWAY PUR- POSES UPON, OVER, 4CROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY; FIXtNG A TIME AND PLACE FOR A HEARING THEREON; AND DIRECTING THE ~OSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS RESOLUTION,.II whereby it declared its intention to vacate and abandon and close to public use that portion of an existing roadway, commonly known as Adams Street, and easement for road- way purposes upon, over, across and along the hereinafter des- cribed property under the provisions of the Street Vacation Act of 1941; and WHEREAS, the City Council in said resolution referred to a map on file i~ the Office of the City Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said portion of roadway and easement for roadway purposes; and WHEREAS, said City Council did by said resolution fix the 24th day of Fe~ruary, 1970, at 1:30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim as the time and place for a public hearing on the matter of such vaca- tion, abandonment and closing to public use of said portion of roadway, commonly known as Adams Street, and easement for roadway purposes, for all persons interested in or objecting to such proposed vacation, abandonment and closing to public use to appear and show cause, if any they had, why such portion of roadway, commonly known as Adams Street, and easement for road- way purposes should not be vacated, abandoned and closed to public use; and WHEREAS, said resolution was published on the 11th day of February, 1970, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, County of Orange, State of California; and WHEREAS, by said resolution said City Council directed that notices of the passage of said resolution and of the time and place of the h~aring on the matter of the vacation, abandon- ment and closing to public use of said portion of roadway, com- monly known as Adams Street, and easement for roadway purposes be posted conspicuously along the line of said portion of roadway and easement, not more than 300 feet apart at least ten (10) days before said hearing, and that not less than three (3) such notices should be posted along the line of said portion of ease- ment; and -1- "'--'~"";---' -~c.. WHEREAS, ~onald R. O'Donnell did on the 11th day of February, 1970, post conspicuously not less than three (3) such notices along the line of said portion of roadway, commonly known as Adams Street, and easement, which notices were posted less than 300 feet apart, and were posted at least ten (10) days before said hearing, and WHEREAS, $aid City Council did on the 24th day of February, 1970, at 1:30 o'clock P.M. at said City Hall, conduct a public hearing on the matter of whether said portion of road- way, commonly known as Adams Street, and easement for roadway purposes, hereinaft~r described, should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon; and WHEREAS, the City Council finds from all evidence sub- mitted that said po~tion of roadway, commonly known as Adams Street, and easement for roadway purposes described in the Resolution of Inten~ion and hereinafter described is unnecessary for present or prospective roadway purposes and that an order vacating and abandoning such portion of roadway, commonly known as Adams Street, and easement should be made. NOW, THE$FORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds the recitals hereinabove set forth in this resolution to be true; 2. That it finds from all evidence submitted that said portion of roadway, commonly known as Adams Street, and ease~nt for roadway purposes described in said resolution is unnecessary for present or prospective purposes; 3. That it ~oes hereby order that said portion of road- way, commonly known as Adams Street, and easement for road~ay purposes be, and it is hereby, vacated, abandoned and closed to public use; 4. That said portion of roadway, commonly known as Adams Street, ~d easement herein ordered vacated, abandoned and closed to public use is that certain portion of roadway and easement for roadway purposes described in said Resolution No. 70R-65, is situated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows: Commencing at the northwest corner of Lot 47 of Anaheim Extension as said northwest corner is shown on a Record of Survey filed in Book 12, page 22 of Record of Surveys, records of Orange County, California; thence following along a portiGn of the west line of said Lot 47 South 00 03' 50" East 40 feet to an intersection with a line parallel with and 40 feet southerly of the centerline of Broadway Street; thence North 890 01' 20" East 132.88 feet along said parallel line to an intersection with the west line of Adams Street 30 feet wide as shown on the last mentioned Record of Survey; thence South 00 17' 20" West 268.22 feet along the west line of said Adams Street to the northwest corner of that certain parcel of land described in the deed to Alvin H. Rohrs and Ida A. Rohrs, recorded September 22, 1969, in Book 9085, pages 206 and -2- '-_.'""""""""""""''''''''''-'''''''' ~~~ '~ 207, records of Orange County, California, said northwest corner being t~e true point of beginning of the herein described parc~l to be abandoned; thence South 00 17' 20" West 132.14 fest along the west line of said Adams Street to a point in ~he northwest corner of the land described in deed record~ November 17, 1964, in Book 7303, page 721, records of Orange County, California; thence North 890 01' 01" East 30.00 feet to an intersection with the east line of saiid Adams Street; thence North 00 17' 20" East 132.79 feet along the east line of said Adams Street to an intersection with the north line of the land con- veyed to said Alvin H. Rohrs and Ida A. Rohrs, husband and wife, in t~e deed recorded September 22, 1969, in Book 9085, pag~s 206 and 207, records of Orang~ County California; th$ce South 870 53' 20" West 30.02 feet along a portion of the north line of the land of Rohrs' to the true point of beginning.
