83R-348 RESOLUTION NO. 83R-348 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AWARDING A CONTRACT FOR THE ANAHEIM BOULEVARD STREET, STORM DRAIN, ELECTRICAL AND WATER IMPROVEMENT, BROADWAY TO BALL ROAD, IN THE CITY OF ANAHEIM, A.H.F.P. NOS. 1047 & 1073, PROJECT NOS. 13-792-6325- E2580; 53-606-6329- 27330-34350; 53-606- 6329-17230-34350; 53-606-6329-27470-34350; 53-619-6329-90240-31500; 55-650-6325-86060- R9000; 5S-650-6329-8637A-36200; 01-676-6329- -12460-37300 and 46-792-6325-E2580. WHEREAS, the City Council of the Ci ty of Anaheim did cause to be published in a newspaper of general circulation, pr inted, published and circulated in the City of Anaheim, to wi t: The Anaheim Bulletin, on the 21st and 28th days of July, 1983, a notice inviting sealed proposals for furnishing the following: All plant, labor, services, materials and equipment, and all utili ties and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike man- ner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: Anaheim Boulevard street, storm drain, electr ical and water improvement, in the Ci ty of Anaheim, consisting of clearing and grubbing; excavation; concrete removal; construction of P.C.C. curb, gutter, sidewalk, access ramps, crossgutters, drive approaches, collars, blankets, alley approaches and crosswalks; construction of asphalt concrete; construction of base material; modification of concrete porches, steps and wood patio cover; construction of curb face drains; demolition of buildings; construction of concrete block retaining walls: construction of concrete block walls and sound walls; reconstruction of manholes: adjustment of man- holes, water valves and survey monuments to grade: installation of survey monuments; construction of undersidewalk drains; construction of R.C.P. storm drain systems and catch basins; construction of R.C.B. storm drain; sheeting, shoring and bracing; installation of pavement markers; signalization and interconnect; relocation of street signs; remodeling of spr inkIer systems; reseeding of lawns; relocation of fencing, trees, commercial signs, light poles and guard posts; construction of street lighting system; construction of redwood gate; construction of chain link fencing; construction of landscaping and irrigation system; -1- "'.""~....,,._.'-~ removal of existing water line; construction of D.I.P. water main including valves, fittings, and thrust blocks; construction of D.I.P. connections including valves, fittings and thrust locks; boring and jacking of steel casing; installation of steel pipe, construction of water services; construction of fire hydrant assembly; construction of well site stand pipe; construction of surge tank including concrete pad; construction of well control concrete block building including instrumentation and electrical service; construction of metering vault and venturi; and all appurtenant work as shown on the plans and delineated in the specifications, in accordance with the design, plans, profiles and specifications of said public improvement on file in the Office of the City Clerk of the City of Anaheim; and WHEREAS, said notice inviting sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 2:00 o'clock P.M. on the 18th day of August, 19S3, for the furnishing of all plant, labor, services, materials and equipment, all utilities and trans- portation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike man- ner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the Ci ty Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be per- formed for each craft or type of workman or mechanic needed to exe- cute the contract, and which wage scale is on file in the offices of the City Clerk and City Engineer; and WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals pr ior to 2: 00 0' clock P.M. on the 18th day of August, 1983, in response to the notice afore- said inviting sealed proposals, to wit: NAME SILVERI & RUIZ CONSTRUCTION COMPANY . . . . . . WHEREAS, the City Council finds that the sealed proposal submi tted by SILVERI & RUIZ CONSTRUCTION COMPANY, 11581 Monarch St., Garden Grove, CA 92641, is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, includ- ing power, fuel and water and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice in- viting sealed proposals, and that said proposal of said above-named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the City Council finds that the above-mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal sub- mitted is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci ty of Anaheim that the sealed proposal submi tted by said con- tractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in str ict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim and the notice in- viting sealed proposals, the public works and improvement here- inabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the construction and completion of said public improvement be, and the same is hereby, awarded to the said above-named bidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby required to execute a contract in the re- quired form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said public improvement here- inabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred percent (100%) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public im- -3- --"-""''''-'-'''-'.~-,,,,~ provement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as security for the faith- ful performance of said contract, and a separate surety bond in an amount equal to one hundred percent (100%) of the construction cost of said public improvement covered by said contract, as security for the payment of all persons performing labor and furnishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the City of Anaheim in companies satisfactory to the Ci ty of Anaheim, public liability, property damage, compensation, and other insurance in the amounts and for the purposes set forth and specified in the notice invi ting sealed proposals, and subject to the approval of the City Attorney as to form and sufficiency. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the Ci ty of Anaheim be, and they are hereby, author ized and directed to make, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particularly described, for the construction, installation and completion of said publ ic improv~thent hereinabove descr ibed upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general speci- fications and detailed specifications and drawings, and all addenda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Off ice of the City Clerk of the Ci ty of Anaheim and in str ict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified.
