RESOLUTION NO. 83R-401
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING VEHICULAR ACCESS RIGHT TO
GILBERT STREET FROM AND TO PROPERTY LOCATED ON
THE EAST SIDE OF GILBERT STREET, NORTH OF BALL
ROAD. (83-5A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 11th day of October, 1983, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of those
vehicular access rights to Gilbert Street, more specifically
described as follows:
That portion of the Vehicular Access Rights in and to
Gilbert Street in the City of Anaheim, County of
Orange, State of California as dedicated to the
County of Orange and acquired by the City of Anaheim
as successor as shown on Tract No. 2563, recorded on
August 25, 1955, as per map filed in Book 78, pages
18 and 19, Miscellaneous Maps, in the Office of the
County Recorder of said Orange County from that
portion shown as "Not a part of this Subdivision" as
indicated on said Tract Map, more particularly
described as follows:
Beginning at the Southwest corner of Lot 51 in said
Tract No. 2563; thence S 89 degrees 22' 14" E, 360.33
feet along the South line of Lots 51 to 55 inclusive
of said Tract to the West line of Lot 57 of said
Tract; thence S 0 degrees 37' 46" W, 282.69 feet
along the West line of Lots 57 to 60 inclusive of
said Tract to the Southwest corner of said Lot 60 on
the North line of the alley shown on the Map of said
Tract No. 2563; thence N 89 degrees 22' 14" W, 360.27
feet along the said North line of the alley to the
East line of Gilbert Street shown on said Tract Map;
thence N 0 degrees 37' 00" E, 282.69 feet along said
East line to the point of beginning.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 11th day of October,
1983.
