83R-437 RESOLUTION NO. 83R-437 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MAKING A FINDING REGARDING THE VALUE OF WRITTEN PROTESTS FILED AND NOT WITH- DRAWN IN ANNEXATION PROCEEDINGS FOR LA PALMA- LAKEVIEW NO. 6 ANNEXATION AND ORDERING THE TERRITORY ANNEXED PURSUANT TO SECTION 35229 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA. WHEREAS, a petition for the proposed annexation designated La Palma-Lakeview No. 6 Annexation to the City of Anaheim in the County of Orange was heretofore filed by the City of Anaheim, as chief petitioner, and accepted for filing on July 26, 1983, by the Executive Officer of Local Agency Formation Commission of Orange County, California (hereinafter "Commission") pursuant to Part 2 of Title 4, Division 2, commencing with Section 35000 et seq of the Government Code; and WHEREAS, the distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: LA PALMA-LAKEVIEW NO. 6 ANNEXATION TO THE CITY OF ANAHEIM; and WHEREAS, said territory proposed to be annexed to the City of Anaheim consists of two non-contiguous parcels of land comprised of a total of approximately 223 acres of land in the County of Orange, and the exterior boundaries thereof are speci- fically described in the legal description attached hereto marked Exhibit "A" and by this reference made a part hereof; and WHEREAS, the Commission has heretofore determined in its Resolution No. 83-56, adopted on August 24, 1983, that the territory proposed to be annexed is uninhabited; and WHEREAS, the City Council of the City of Anaheim has heretofore adopted its Resolution No. 83R-381 initiating proceedings pursuant to Section 35220 of the Government Code for the annex- ation of the hereinabove described territory to the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim con- ducted a duly noticed public hearing on November I, 1983, and did hear and receive all oral and written protests, objections, and evidence made, presented or filed in opposition to the proposed annexation of the hereinabove described territory to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. That the City Council does hereby find that written protests have been filed and not withdrawn by the owners of land and improvements who own zero percent of the total assessed value of land and improvement within the territory hereinabove described and that the value of said written protests is less than fifty percent of the total assessed value of land and improvements within said territory. 2. That the City Council does hereby order the annex- ation of the hereinabove described territory to the City of Anaheim pursuant to Section 35229 of the Government Code of the State of California. 3. That the following terms and conditions were imposed upon said annexation pursuant to Commission Resolution No. 83-56: a. That the boundaries of the territory to be annexed to the City of Anaheim are specifically described in the legal description attached to said Commission Resolution No. 83-56 and by such reference made a part thereof. Said territory was found to be uninhabited and was assigned the following short term designation: LA PALMA-LAKEVIEW NO.6 ANNEXATION TO THE CITY OF ANAHEIM. b. The City of Anaheim was designated as the con- ducting authority and the City Council thereof was directed to initiate annexation proceedings in compliance with said Commission Resolution. c. Any election called upon the question of con- firming an order for annexation shall be called, held and con- ducted upon such annexation only within the territory ordered to be annexed. d. The City of Anaheim, as applicant, shall be liable for and pay all proper expenses incurred in conducting proceedings for the annexation. 4. That the City Clerk shall file a certified copy of this Resolution with the Executive Officer of the County of Orange Local Agency Formation Commission. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 8th day of November, 1983. ~d~ MAYOR OF THE CITY OF ANAHEIM ATTEST: ~.~~)~ CITY LERK OF THE C T OF ANAHEIM JLW/kh 0249U 9/16/83 '.,,,-,.......,...-.,-- EXHIBIT "A" La Palma - Lakeview No. 6 Annexation to the City of Anaheim PARCEL 1: That certain parcel of land located in the unincorporated territory of the County of Orange, State of California, more particularly described as follows: Beginning at an angle point in the existing boundary line of the City of Anaheim, as said angle point was established by the "Peralta Hills No. 2 Annexation" and "Northeast No. 3 Annexation" to said City of Anaheim; thence along said existing boundary line of the City of Anaheim per "Northeast No.3 Annexation," per "Fee Ana Street Annexation," per "La Palma-Fee Ana Annexation," per "La Palma-Lakeview No.3 Annexation," per "La Palma-Lakeview No.2 Annexation," per "La Palma-Lakeview No.4 Annexation," per "La Palma-Lakeview No.1 Annexation," per "Warner Lambert Annexation," per "La Palma-Lakeview No.5 Annexation," per "East-La Palma Annexation," per "Orangethorpe-La Palma Annexation," per "Yorba No.2 Annexation," per "Yorba Annexation," and per said "Peralta Hills No. 2 Annexation" in a general Northerly, Easterly, Southerly and Westerly direction to the Point of Beginning. PARCEL 2: That certain parcel of land located in the unincorporated territory of the County of Orange, State of California, more particularly described as follows: Beginning at an angle point in the existing boundary line of the City of Anaheim, said angle point being the Northeast corner of the "La Palma- Fee Ana Annexation," to the City of Anaheim; thence along said existing boundary line of said city per "Northeast No.3 Annexation," per "La Palma- Lakeview No.2 Annexation," per "La Palma-Lakeview No.3 Annexation," per said "La Palma-Fee Ana Annexation," in a general Easterly, Southerly, Westerly and Northerly direction to the Point of Beginning. The above described parcels of land contain 223 acres, more or less. Attached and made a part is a map designated as Exhibit "B". This proposal does meet the approval of the Surveyor's Office. C.
