83R-439 RESOLUTION NO. 83R-439 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING PUBLIC UTILITY EASEMENTS EXTENDING FROM HAYWARD STREET, WEST OF BEACH BOULEVARD AND NORTH OF ROME AVENUE. (83-6A). WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 8th day of November, 1983, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not reserved and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of certain public utility easements, more specifically described as follows: Those certain easements for public utility purposes in, on and over a 6.00 foot wide strip of land in the City of Anaheim, County of Orange, State of California as conveyed by deeds to the Southern California Edison Company, as recorded on February 16, 1955 in Book 2961, page 539 and re-recorded September 18, 1957 in Book 4041, page 97 Official Records of said Orange County and recorded on October 30, 1957 in Book 4086, page 101 Official Records of said Orange County, said easements acquired by the City of Anaheim as successor. The said herein above described public utility easements to be abandoned are also shown on Tract No. 11820, being the southerly 6.00 feet of Lot 1 of said Tract, per map recorded in Book 511, pages 10 and 11 of Miscellaneous Maps in the Office of the County Recorder of said Orange County. c"""-v......-.<>..."_,,,,_""'," BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange.
