RESOLUTION NO. 70R- 69
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT FOR ROAD AND
PUBLIC UTILITY PURPOSES OVER, UNDER AND ACROSS
CERTAIN PROPERTY OF SOUTHERN PACIFIC TRANSPOR-
TATION COMPANY, AND AUTHORIZING THE EXECUTION
OF AN INDENTURE GRANTING SAID EASEMENT.
WHEREAS, the Southern Pacific Transportation Company,
a corporation of the State of Delaware, has tendered to the City
of Anaheim an Indenture, executed by said company, granting to
the City of Anaheim an easement for road and public utility
purposes over, under and across the following described real
property, subject to the reservations, covenants and conditions
therein contained:
Parcell:
Beginning at the Northeast corner of the Northeast quarter
of said Section 23, said Northeast corner being the inter-
section of the centerline of State College Boulevard and
Ball Road; thence South 890 56' 28" West along the center-
line of said Ball Road 1323.21 feet to the True Point of
Beginning; thence South 00 15' 38" East 53.00 feet; thence
South 890 56' 28" West 30.00 feet; thence North 00 15' 38"
West 53.00 feet to a point in the centerline of Ball Road,
said point hereinafter referred to as Point "A"; thence
North 890 56' 2811 East along said centerline, 30.00 feet
to the True Point of Beginning.
Parcel 2:
Beginning at point "A" referred to in the above described
Parcel One; thence South 890 56' 28" West along the center-
line of Ball Road 771.22 feet to the True point of Begin-
ning; thence South 00 15' 12" East 53.00 feet; thence
South 890 56' 28" West 30.00 feet; thence North 00 15' 12"
West 53.00 feet to the intersection with the centerline
of said Ball Road; thence North 890 56' 28" East along
said centerline 30.00 feet to the True Point of Beginning.
AND WHEREAS, said grantor has tendered to the City
said above-mentioned Indenture to be executed by the City of
Anaheim, which Indenture the City Council finds would be for the
benefit and best interests of the City of Anaheim and should be
approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that the Indenture above-mentioned tendered
to the City by Southern Pacific Transportation Company, a corpora-
tion of the State of Delaware, granting to the City, but subject
to the reservations, covenants and conditions therein contained,
an easement for road and public utility purposes over, under and
across the real property hereinabove mentioned and described,
be, and the same is hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said
Indenture for and on behalf of the City of Anaheim.
