RESOLUTION NO. 70R- 51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF A LICENSE AGREEMENT BETWEEN THE
CITY OF ANAHEIM AND THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY PROVIDING FOR A
PROJECT OF WIDENING AND ,IMPROVING: CROWTHER
AVENUE AND ENCROACHING ON THE EMBANKMENT SLOPE
OF SANTA FE'S RIGHT-OF-WAY.
WHEREAS, the City of Anaheim proposes to widen
Crowther Avenue aad in thus doing encroaching on the right-of-
way of The Atchison, Topeka and Santa Fe Railway Company's
embankment slope from 138 feet East of Oxford Street to 1577
feet East thereof; and
WHEREAS, said Railway Company is willing that the
City widen Crowther Avenue and thus encroach upon its right-of-
way; and
WHEREAS, the parties desire to enter into a License
Agreement permitting the widening of Crowther Avenue; and
WHEREAS, The Atchison, Topeka and Santa Fe Railway
Company has tendered to the City an agreement to be entered
into between the parties providing for the widening of said
Crowther Avenue, the terms and conditions of which the City
Council finds are satisfactory and should be approved.
NOW, T~REFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this date tendered to
the City Council by The Atchison, Topeka and Santa Fe Railway
Company to be made and entered into between the parties pro-
viding for the encroachment by the City on the Santa Fe's right-
of-way from 138 feet East of Oxford Street to 1577 feet East
thereof be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of January , 1970.
