RESOLUTION NO. 70R- 50
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF A RIGHT OF ENTRY LICENSE BETWEEN
THE CITY OF ANAHEIM AND THE ATCHISON, TOPEKA
AND SANTA FE RAILWAY COMPANY AUTHORIZING A
RIGHT-OF-WAY IN CONNECTION WITH CONSTRUCTION
OF TUSTIN AVENUE AT CROSSING 2N-0.8.
WHEREAS, the City of Anaheim proposes to improve a
portion of Tustin Avenue on the premises occupied by Santa Fe's
right-of-way; and
WHEREAS, said Railway Company is willing that the
City improve said street across its right-of-way as a public
street crossing and has submitted a License Agreement for the
City's execution, the terms and conditions of which the City
Council finds are satisfactory and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the License Agreement this date tendered
to the City by The Atchison, Topeka and Santa Fe Railway Company
to be made and entered into between the parties providing for the
City's contractor to enter a designated portion of Santa Fels
right of way in conjunction with the construction of Tustin
Avenue at Crossing 2N-0.8 in accordance with the terms and
conditions of said License Agreement be, and the same is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby authorized to execute said agree-
ment for and on behalf of the City of Anaheim.
