RESOLUTION NO. 83R-238

A RESOLUTION OF THE CITY COUNCIL OF THE CtTY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE
BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceedings
No. 82-83-26 to consider an amendment to Title 18 of the Anaheim
Municipal Code relating to zoning, and to consider a change in the
boundaries of the zone or zones hereinafter mentioned and described
and, at said hearing, did receive evidence and reports from persons
interested therein and from its staff; and
WHEREAS, within a period of forty (40) days following
said hearing, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing and approved the proposed amendment; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and did consider the
same; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should be
adopted and that the property hereinafter described should be
excluded from the zone or zones in which it is now situated and
incorporated in the zone and zones as hereinafter set forth; and
WHEREAS, the City Council does further find and determine
that said reclassification is required by public necessity and
convenience and the general welfare.

City of Anaheim that Title 18 of the Anaheim Municipal Code be, and

AGRICULTURAL ZONE of the City of Anaheim, subject to the following
conditions:
l. That prior to introduction of an ordinance reclassifying
the property from the Mobilehome Park Overlay Zone, specific devel-
opment plans (or further discretionary permits) shall be submitted
to and approved by the Planning Commission or City Council.

2. That prior to (a) termination of the tenancy of any resi-
dent mobilehome owner for any reason by the park owner or mobile-
home owner; or (b) adoption of an ordinance rezoning that portion
of subject property upon which such mobilehome is located from the
(MHP) Overlay Zone, Or (c) issuance of any building permits for
development of any portion of subject property, whichever occurs
first, the owners of subject property shall pay to each displaced
mobilehome owner (as identified in the Conversion Impact Report) or
such owner's successors in interest, relocation benefits in accord-
ance with Section 18.92.060.040 of the Anaheim Municipal Code for
the actual cost of relocation of such mobile home, which amount
shall be not less than the total minimum amount as set forth on
Exhibit A, attached hereto, and incorporated herein by this refer-
ence, or such other benefits as mutually agreed upon between the
park owner and the mobilehome owner (including those certain alter-
native forms of compensation identified as Alternatives A, Band C
as set forth in the Conversion Impact Report). Said relocation
benefits shall be paid to each displaced mobilehome owner and proof
thereof submitted to the City in a form satisfactory to the City
Attorney. In the event of payment of the minimum amount set forth
on Exhibit A hereof, said park owner shall also pay to be mobile-
home owner interest thereon at the rate of 10% per annum, simple
interest, calculated from the date of this resolution to the date
of payment.
BE IT FURT'ER RESOLVED that, nothwithstanding any other
provision hereof to the contrary, nothing contained herein shall be
deemed to require the payment of any relocation benefits for any
unit which is not a mobilehome as defined in Section 18.0l.140 of
the Anaheim Municipal Code.
BE IT FURT,ER RESOLVED that the City Council of the City
of Anaheim does here~y find and determine that the adoption of this
Resolution is expres$ly predicated upon applicant's compliance with
each and all of the ~onditions hereinabove set forth. Should any
condition or any part thereof, be declared invalid or unenforceable
by the final judgment of any court of competent jurisdiction, then
this Resolution, and any approvals herein contained, shall be
deemed null and void.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 7th day of June, 1983.
