83R-236 !ESOLUTION NO. 83R-236 - A RESOLUTION 'OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ~ENDING THE CONDITIONS OF APPROVAL AS SET FORTHIIN RESOLUTION NO. 79R-607, AS AMENDED, REL~TING TO ZONING RECLASSIFICATION PROCEEDINGS $0. 77-78-64. WHEREAS, theiCity Council of the City of Anaheim adopted Resolution No. 79R-50 ~n January 23, 1979, in Zoning Reclassification Proceedings No. 77-78- 4, finding and determining that Title 18 of the Anaheim Municipal ode relating to zoning boundaries should be amended and that the b~undaries of certain zones should be changed, subject to certain con~itions of approval contained therein; and WHEREAS, sai~ Resolution No. 79R-50 was subsequently amended by Resolution $0. 79R-607 on October 16, 1979; and WHEREAS, sai~ Resolution No. 79R-607 was itself amended by Resolution No. 80R-4810n October 28, 1980, and by Resolution No. 82R-313 on June 8, 198~; and WHEREAS, the Planning Commission of the City of Anaheim has heretofore determined that the public necessity, convenience and general welfare requir~ the amendment of the conditions of approval of said Resolution No. 79R-607, as amended, and has recommended such amendment to the City ~ouncil; and WHEREAS, the City Council has heretofore held a duly noticed public hearing; to consider said amendment of conditions and did give all persons i~terested therein an opportunity to be heard and did receive reportt and evidence, and did consider the same; and WHEREAS, the'City Council does find and determine that the public necessity, conv~nience and general welfare require that the conditions of approval of said Resolution No. 79R-607, as amended, be amended in the manner hereinafter set forth. NOW, THEREFO~E, BE IT RESOLVED by the City Council of the City of Anaheim that t~e conditions of approval, Nos. 3, 21 and 22 as set forth in Resolutio~ No. 79R-607, as amended, (amending Resolution No. 79R-50) relating t~ Zoning Reclassification Proceedings No. 77-78-64 be, and the s~me are hereby, amended, respectively, to read as follows: 77-78-64 "3. That the num~er of dwelling units per acre proposed (in connection with tract maps, parcel maps, or oth~r development plans) for each land use area in the Bauer Ranch Planned Community may be equal to ~ut shall not exceed the average density as atProved in the Bauer Ranch General Plan of Deve opment unless such proposal to transfer dwe ling units between or within land use areas isisubmitted to and approved by the Planning Co~ission with the consent of the City Councilor bt the City Council upon appeal from any PlanningiCommission action. Plans for any proposed tra~sfer of dwelling units shall iden- tify the lan~ use areas affected and shall spec- ify both theiapproved and the proposed dwelling unit counts in all affected land use areas. The total dwelli*g unit count in the Bauer Ranch Planned Comm~nity shall not exceed 945." "21. That, prior to the introduction of the first ordinance to!establish zoning on any parcel(s) excepting cOimercial parcels within the Bauer Ranch Planni g Community, a revised specific pub- lic faciliti s plan addressing Revision No. 4 of Exhibit No. ~ of the Bauer Ranch General Plan of Development, including implementation programs, shall be protided by the developers of the entire Planned Comm$nity (Kaufman and Broad, Inc. or their succestors, assignees, or transferees) and approved by he City Council. The specific plan shall includ , but not be limited to, a discus- sion and eva~uation of the following: a. Identification of all the public facilities propos,d for the area including, but not limite~ to, public streets, landscaped med- ians a$d parkways; public parks and open spaces; police and fire facilities; librar- ies; e~uestrian and hiking trails; bicycle lanes; electric utilities such as substa- tions; ,transmission lines; and street lighti*g; and water utilities such as transmission mains and reservoirs. b. Ultimate development capacities of the pub- lic fa~ilities for the area. c. Land ptoposed to be reserved for public facility purposes. d. Cost t~ the City of Anaheim for all public facilities. -2- e. Alignm~nt, phasing and bonding for all right-~f-way for all scenic expressways and arteri.l highways including equestrian and hiking trails and bicycle lanes; storm drainsf utility easements and other public facilities. "22. Specific means of financing the installa- tion, ~onstruction, and maintenance of all publici facilities; such means may include but ar. not limited to, reimbursement dis- trictsr assessment districts, in-lieu fees, establishment of a master homeowners asso- ciatio$, etc.; provided that the specific means for each public facility shall be approv+d by the City of Anaheim." . ; That SUbJecttProperty shall be developed substan- tially in ac ordance with the Bauer Ranch General Plan of Deve opment on file with the city of Anaheim and $arked Revision No. 4 of Exhibit No. l; provided, 'however, that the total dwelling unit count Slall not exceed 945, although trans- fer of units between land use areas may be approved by he Planning Commission with the con- sent of theity Council, or by the City Council upon appeal ~rom any Planning Commission motion, following su~mittal of precise plans for such transfer, as 'discussed in the preceding Condition No.3.
