RESOLUTION NO. 83R-70
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 3319.

WHEREAS, after a request for variance by JOHN and ANNE
KRAJACIC, owners, was received, a public hearing before the
Planning Commission of the City of Anaheim was held upon due and
proper notice, a result of which Variance No. 3319 to establish a
two-lot subdivision with waivers of minimum lot area, lot width,
and required lot frontage was denied covering the following
described property:
THAT PORTION OF LOT SEVENTEEN OF THE "ANAHEIM
HOMESTEAD TRACT", IN THE CITY OF ANAHEIM, AS SHOWN ON
A MAP RECORDED IN BOOK 26, PAGE 10 OF MISCELLANEOUS
RECORDS OF LOS ANGELES COUNTY, CALIFORNIA, DESCRIBED
AS FOLLOWS:
BEGINNING AT A POINT IN THE CENTER LINE OF NORTH
STREET, DISTANT SOUTH 350 19' WEST 180.00 FEET FROM
THE INTERSECTION OF THE CENTER LINE OF NORTH STREET
HITH THE CENTER LINE OF WEST STREET AS SHOWN ON SAID
MAP; THENCE SOUTH 850 19' WEST ALONG THE CENTER LINE
OF NORTH STREET, A DISTANCE OF 85.00 FEET; THENCE
SOUTH 170.66 FEET TO THE NORTH LINE OF LAND DESCRIBED
IN DEED TO RUTH BROWN, AN UNMARRIED WOMAN, RECORDED
MAY 8, 1952 IN BOOK 2326, PAGE 519 OF OFFICIAL
RECORDS; THENCE EASTERLY ALONG THE NORTH LINE OF SAID
LAND OF RUTH BROWN, A DISTANCE OF 85.00 FEET; THENCE
NORTH 170.66 FEET TO THE POINT OF BEGINNING; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there no special circumstances applicable to the
property which do not apply to other property in the same vicinity
and zone.
2. That strict application of the zoning code does not
deprive the property of privileges enjoyed by other property in
the same vicinity and zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said Variance be, and the same is hereby,
denied.

BE IT FURTHER RESOLVED that the time within which judi-
cial review of the herein decision must be sought is governed by
Section 1094.6 of the Code of Civil Procedure.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 22nd day of February,
1983.
