RESOLUTION NO. 83R-69
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONSENT TO THE FORMATION
OF ASSESSMENT DISTRICT NO. 83-1 BY THE CITY
OF YORBA LINDA, CALIFORNIA.
WHEREAS, the City Council of the City of Yorba Linda,
California ("Yorba Linda") did on the 6th day of December, 1982,
by its Resolution No. 1656 declare its intention to order the
construction of certain improvements in proposed Assessment
District No. 83-1 pursuant to the Municipal Improvement Act of
1913, and for the issuance of bonds in the proceedings under the
Improvement Bond Act of 1915; and
WHEREAS, said Assessment District No. 83-1 proposes the
construction of certain public improvements upon land a portion of
which is within the City of Yorba Linda and a portion of which is
currently within the unincorporated area of the County of Orange
("unincorporated area"); and
WHEREAS, the Local Agency Formation Commission of Orange
County, California, did on the 12th day of January, 1983, adopt
its Resolution No. 83-2 directing the City Council of the City of
Anaheim to initiate annexation proceedings to annex said
unincorporated area into the City of Anaheim ("Santa Ana Canyon
No. 11 Annexation to the City of Anaheim") and further directing
the City Council of the City of Anaheim to adopt its resolution
consenting to the formation of the City of Yorba Linda Assessment
District No. 83-1 prior to the issuance of a certificate of
completion for said annexation by the Executive Officer of the
Local Agency Formation Commission.
WHEREAS, the City Council of the City of Anaheim did on
the 18th day of January, 1983, adopt its Resolution No. 83R-21
initiating annexation proceedings for said Santa Ana Canyon No. 11
Annexation to the City of Anaheim; and
WHEREAS, the City Council of the City of Anaheim did on
the 22nd day of February, 1983, adopt its Resolution No. 83R-68
making a finding regarding the value of written protests filed and
not withdrawn in said annexation proceedings and ordering the
territory annexed to the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim as follows:
SECTION 1. That the public convenience and necessity
require the improvements as referred to in said Resolution No.
1656 of the City Council of the City of Yorba Linda and that all
of the lands included within the boundaries of Assessment District
No. 83-1 to be assessed therefor, and lying within the City of
Anaheim, will be benefited by the proposed improvements.

SECTION 2. That the City Council of the City of Anaheim
hereby grants its consent to the formation of Assessment District
No. 83-1 referred to in said Resolution No. 1656 of the City of
Yorba Linda, to the improvements therein described, and to the
assumption of jurisdiction by the City Council of the City of
Yorba Linda for all purposes in connection therewith; provided,
however, that the City of Anaheim reserves the right to prohibit
construction in said Assessment District No. 83-1 of any proposed
facilities to be located in the City of Anaheim which are not in
substantial conformity with applicable City of Anaheim standards
other than the circulation system facilities (including location
of all streets, paving and street construction) specified in City
of Yorba Linda Resolution No. 1656.
SECTION 3. That the City Clerk of the City of Anaheim
be, and she is hereby, directed to forward a certified copy of
this Resolution to the City Clerk of the City of Yorba Linda and
to the Executive Officer of the Local Agency Formation Commission
of Orange County, California.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 22 day of February, 1983.
