A RESOLUT~ON OF THE CITY COUNCIL OF THE CITY
OF ANAHEI FINDING AND DETERMINING THAT PUBLIC
CONVENIEN E AND NECESSITY REQUIRE THE CONSTRUC-
TION AND OMPLETION OF A PUBLIC IMPROVEMENT,
TO WIT:
LINCOLN-MAGNOLIA STORM DRAIN IMPROVEMENT, IN THE
CITY OF A~AHEIM, ACCOUNT NO. 24-79l-6325-E1240.
WHEREAS, public convenience and necessity require the
construction and co~pletion of a public improvement in the City
of Anaheim, to wit:
Lincoln-Magnol~a Storm Drain Improvement, from 254'
east of Magno~ia Avenue to the O.C.F.C.D. Channel
west of Magno~ia Avenue and from Lincoln Avenue to
186' south of Lincoln Avenue, in the City of
Anaheim, cons~sting of the construction of a 42"
R.C.P. storm d~ain including catch basins, laterals,
manholes, A. C.. pavement and all other work as shown
on the plans a~d delineated in the specifications on
file in the of~ice of the City Engineer, Account No.
24-79l-6325-El~40; and
WHEREAS, ~he City Council instructed the Public Works
Department to prep~re detailed designs, plans, profiles, draw-
ings and specifica~ions, and estimates of quantities and costs
and make necessary surveys for the construction of said public
improvement; and
WHEREAS, said Public Works Department has prepared
said detailed designs, plans, profiles, drawings and specifica-
tions for the cons~ruction of said public improvement and has
submitted the same to the City Council; and
WHEREAS, the City Council finds that said detailed
designs, plans, prd>f iles, drawings and specifications for said
public improvement above mentioned, are in accordance with good
engineering practiqe and are adequate to serve the needs and
requirements of the City of Anaheim and the citizens and resi-
dents in said area for the purposes for which they are intended,
and that they are adequate for the construction of said public
improvement and shoOld be approved.
NOW, THER~FORE, BE IT RESOLVED by the City Council of
the City of Anahei~ that the detailed designs, plans, profiles,
drawings and speci~ications for said public improvement herein-
above mentioned and described be, and the same are hereby,
approved and adoptea as prepared by said Public Works Department.

BE IT FURTHER RESOLVED that said public improvement
shall be construct$d in accordance with said detailed designs,
plans, profiles, drawings and specifications as prepared by said
Public Works Depart~ent and hereby approved, and such addenda or
modifications ther~to as may be approved prior to the awarding
of bids therefor. .
BE IT FU~THER RESOLVED that the City Clerk of the City
of Anaheim be, an4 she is hereby, authorized and directed to
publish a notice adcording to law, inviting sealed proposals for
the furnishing of all plant, labor, services, materials and
equipment, and all utilities and transportation, including
power, fuel and water, and performing all work necessary to con-
struct and complete, in a good and workmanlike manner, in strict
accordance with said detailed designs, plans, profiles, drawings
and specifications I as prepared by said Public Works Department,
the public improvements hereinabove mentioned and described, and
fixing the 17th d~y of February, 1983, at the hour of 2: 00
o'clock P.M. as th~ date and hour for the opening of said bids
at the Ci ty Council Chamber in the Ci ty Hall in the Ci ty of
Anaheim, and that said notice shall be published twice, the
fir st of which publ icat ions shall be at least ten ( 10) days
prior to the date fixed for the opening of bids, and that said
publications shall be at least five (5) days apart.
BE IT FU~THER RESOLVED that the successful bidder or
bidders shall be required to enter into a contract with the City
of Anaheim in the ~anner and form approved by the City Attorney
of the Ci ty of An~heim for the construction, installation and
completion of said public improvement hereinabove mentioned and
described, in accotdance with the plans and specifications pre-
pared by said Pu~lic Works Department, the notice inviting
sealed proposals, this resolution and all applicable City
Ordinances or Cod~ Sections and the laws of the State of
California, and shall be required to post bonds and insurance in
the amounts and wiohin the time required by law, as specified in
the notice inviting sealed proposals, and in a form approved by
the City Attorney.
