RESOLUTION NO. 831(-5
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING A PORTION OF "OLD" SANTA
ANA CANYON ROAD LYING WITHIN THE S.A.V.I. CANAL
(PARCEL 1) AND A PORTION OF THE EASTERLY HALF
OF THE S.A.V.I. CANAL (PARCEL 2). (82-5A).
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by
law; and
WHEREAS, on the 4th day of January, 1983, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires
that no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of a portion
of the "Old" Santa Ana Canyon Road, more specifically described
as follows:
PARCEL 1
The real property in the City of Anaheim, County of
Orange, State of California, described as follows:
That portion of Section 1, Township 4 South, Range 9
west, being a portion of the land allotted to Paula
de Dominquez in Decree of partition of Rancho
Santiago de Santa Ana recorded in Book "B" of
Judgements of the 17th Judicial District Court of
California, described as follows:
AND
That portion of the "Old" Santa Ana Canyon Road known
as Parcel 4, as shown on a map attached to
Relinquishment No. 820, recorded as Document No.
30024 on October 30, 1973, records of said Orange
County, lying within the S.A.V.I. Canal, as described
in a deed recorded October 9, 1947 in Book 1536, page
487, Official Records of said Orange County.
PARCEL 2
The Real Property in the City of Anaheim, County of
Orange, State of California, described as follows:
That portion of Section 1, Township 4 South, Range 9
West, being a portion of the land allotted to Paula
de Dominquez in Decree of Partition of Rancho
Santiago de Santa Ana recorded in Book "B" of
Judgements of the 17th JUdicial District Court of
California, described as follows:
Beginning at the northwesterly corner of Lot 25 of
Tract 9144, as shown on a map recorded in Book 388,
page 30, Miscellaneous Maps, records of said Orange
County; thence N 760 25' 57" W, 26.70 feet to a point
in the centerline of the right of way granted to the
Santa Ana Valley Irrigation Company by deed recorded
October 9, 1947 in Book 1536, page 487, Official
Records of said Orange County; thence along said cen-
terline N 070 01' 27" W, 146.57 feet; thence N 070
17' 53" E, 127.56 feet; thence N 270 39' 18" E,
129.77 feet to a point; thence N 280 48' 16" W, 28.00
feet to the southerly right of way line of the Santa
Ana Canyon Road; thence N 610 11' 44" E along said
southerly line, 177.61 feet to the point of intersec-
tion with the easterly line of said Santa Ana Valley
Irrigation Company right of way; thence S 440 50' 38"
W along said easterly line, 168.51 feet; thence S 270
39' 18" W, 127.80 feet; thence S 070 17' 53" W,
119.93 feet; thence S 070 01' 27" E, 152.82 feet to
the point of beginning.
Reserving therefrom an easement over, along and
across the most southerly 10.00 feet for a riding and
hiking trail, and
Also reserving therefrom an easement over, along and
across a portion of the westerly one-half of said
S.A.V.I. Canal described as follows:

Commencing at the intersection of the southerly right
of way line of said Santa Ana Canyon Road and the
easterly right of way line of said S.A.V.I. Canal;
thence S 610 11' 44" W along southerly line of Santa
Ana Canyon Road, 137.61 feet to the true point of
beginning; thence continuing along said line S 610
11' 44" W, 40.00 feet; thence S 280 48' 16" E, 28.00
feet to a point in the centerline of said S.A.V.I.
Canal; thence Northeasterly in a direct line to the
true point of beginning.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 4th day of January, 1983.
