84R-180 RESOLUTION NO. 84R-180 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MAKING A FINDING REGARDING THE VALUE OF WRITTEN PROTESTS FILED AND NOT WITH- DRAWN IN ANNEXATION PROCEEDINGS FOR LA PALMA-RED GUM ANNEXATION AND ORDERING THE TERRITORY ANNEXED PURSUANT TO SECTION 35229 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA. WHEREAS, a petition for the proposed annexation desig- nated La Palma-Red Gum Annexation to the City of Anaheim in the County of Orange was heretofore filed by the City of Anaheim, as chief petitioner, and accepted for filing on December 15, 1983, by the Executive Officer of Local Agency Formation Commission of Orange County, California (hereinafter "Commission") pursuant to Part 2 of Title 4, Division 2, commencing with Section 35000 et seq. of the Government Code; and WHEREAS, the distinctive short form designation as- signed by the Commission to the territory proposed to be annexed is: LA PALMA-RED GUM ANNEXATION TO THE CITY OF ANAHEIM; and WHEREAS, said territory proposed to be annexed to the City of Anaheim consists of approximately 47.31 acres of land in the County of Orange, and the exterior boundaries thereof are specifically described in the legal description attached hereto marked Exhibit "A" and by this reference made a part hereof; and WHEREAS, the Commission has heretofore determined in its Resolution No. 84-9, adopted on February 1, 1984, that the territory proposed to be annexed is uninhabited; and WHEREAS, the City Council of the City of Anaheim has heretofore adopted its Resolution No. 84R-130 initiating proceedings pursuant to Section 35220 of the Government Code for the annexation of the hereinabove described territory to the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim con- ducted a duly noticed public hearing on May 15, 1984, and did hear and receive all oral and written protests, objections, and evidence made, presented or filed in opposition to the proposed annexation of the hereinabove described territory to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: ......,~"~-~~-"=' 1. That the City Council does hereby find that written protests have been filed and not withdrawn by the owners of land and improvements who own 9.28% percent of the total assessed value of land and improvements within the territory hereinabove described and that the value of said written protests is less than fifty percent of the total assessed value of land and improvements within said territory. 2. That the City Council does hereby order the annexation of the hereinabove described territory to the City of Anaheim pursu- ant to Section 35229 of the Government Code of the State of California. 3. That the following terms and conditions were imposed upon said annexation pursuant to Commission Resolution No. 84-9: a. The boundaries of the territory proposed to be annexed to the City of Anaheim are specifically described in the legal description attached to said Commission Resolution No. 84-9 and by such reference made a part thereof. Said territory was found to be uninhabited and was assigned the following designation: LA PALMA-RED GUM ANNEXATION TO THE CITY OF ANAHEIM. b. The City of Anaheim was designated as the conduct- ing authority and the City Council thereof was directed to initiate annexation proceedings in compliance with said Commission Resolution. c. Any election called upon the question of confirm- ing an order for annexation shall be called, held and conducted upon such annexation only within the territory ordered to be annexed. d. The City of Anaheim, as applicant, shall be liable for and pay the applicable State Board of Equalization filing and processing fee prior to the issuance of the final statement of boundary change by the Executive Officer of the Local Agency Formation Commission. 4. That the City Clerk shall file a certified copy of this Resolution with the Executive Officer of the County of Orange Local Agency Formation Commission.
