84R-104 RESOLUTION NO. 84R-l04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 2259. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from AMERICAN NATIONAL PROPERTIES, INC., owner, to permit a five-story office building in the Commercial, Recreation (C-R) Zone of the City upon certain real property located within the City of Anaheim, County of Orange, State of California, legally described as: THOSE PORTIONS OF THE EAST HALF OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER AND THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 26, TOWNSHIP 4 SOUTH, RANGE 10 WEST, S.B.B. & M., IN THE RANCHO SAN JUAN CAJON DE SANTA ANA, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 51 PAGE 7 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST LINE OF SAID EAST HALF OF SAID SOUTHEAST QUARTER OF SAID NORTHWEST QUARTER, DISTANT THEREON NORTH 00 02' 20" EAST 40.00 FEET FROM THE CENTER OF SAID SECTION 26, SAID POINT BEING ON THE NORTH LINE OF ORANGEWOOD AVENUE, 40.00 FEET WIDE, AS DESCRIBED IN THE DEED TO THE COUNTY OF ORANGE, RECORDED IN BOOK 231, PAGE 230 OF DEEDS, RECORDS OF ORANGE COUNTY, THENCE ALONG SAID NORTH LINE NORTH 880 41' 15" WEST 358.19 FEET TO A LINE PARALLEL WITH AND DISTANT 2.00 FEET, MEASURED AT RIGHT ANGLES, WEST FROM THE SOUTHERLY PROLONGATION OF THE EAST LINE OF TRACT NO. 3017, AS PER MAP RECORDED IN BOOK 138, PAGES 15 AND 16 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY; THENCE ALONG SAID PARALLEL LINE NORTH 00 01' 47" EAST 160.04 FEET: THENCE NORTH 880 41' IS" WEST 2.00 FEET TO SAID EAST LINE OF SAID TRACT NO. 3017: THENCE ALONG SAID EAST LINE AND IT'S NORTHERLY PROLONGATION NORTH 00 01' 47" EAST 491.57 FEET TO A POINT ON THE SOUTH LINE OF PARCEL 2, AS PER MAP FILED IN BOOK 62, PAGE 5 OF PARCEL MAPS, RECORDS OF ORANGE COUNTY; THENCE ALONG SAID SOUTH LINE SOUTH 880 44' 01" EAST 308.18 FEET TO THE SOUTHWESTERLY LINE OF MANCHESTER AVENUE, 47.00 FEET WIDE, AS SHOWN ON SAID PARCEL MAP 6275; THENCE ALONG SAID SOUTHWESTERLY LINE SOUTH 390 30' 19" EAST 159.55 FEET TO THE BEGINNING OF A TANGENT CURVE CONCAVE SOUTHWESTERLY AND HAVING A RADIUS OF 970.00 FEET; THENCE SOUTHEASTERLY ALONG SAID -1- '""'"'-""_'__'_'__'F~ CURVE AN ARC LENGTH OF 80.76 FEET THROUGH A CENTRAL ANGLE OF 40 46' 13"; THENCE TANGENT TO SAID CURVE SOUTH 340 44' 06" EAST 90.87 FEET TO THE BEGINNING OF A TANGENT CURVE CONCAVE SOUTHWESTERLY AND HAVING A RADIUS OF 220.00 FEET; THENCE SOUTHEASTERLY ALONG SAID CURVE AN ARCLENGTH OF 61.87 FEET THROUGH A CENTRAL ANGLE OF 160 06' 49" TO A POINT ON SAID CURVE TO WHICH A RADIAL LINE BEARS NORTH 710 22' 43" EAST; THENCE NORTH 880 40' 28" WEST 177.84 FEET TO SAID AFOREMENTIONED EAST LINE OF SAID EAST HALF OF SAID SOUTHEAST QUARTER OF SAID NORTHWEST QUARTER; THENCE ALONG SAID EAST LINE SOUTH 00 02' 20" WEST 339.90 FEET TO SAID NORTH LINE OF ORANGEWOOD AVENUE AND POINT OF BEGINNING; and WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC83-l77 denying Conditional Use Permit No. 2259; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consi- deration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoin- ing land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. -2- ._"'-.......~,,_.~ 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that, for the reasons hereinabove stated, the action of the City Planning Commission denying said conditional use permit be, and the same is hereby, reversed and that Conditional Use Permit No. 2259 be, and the same is hereby, granted permitting a five-story office building in the Commercial, Recreation (C-R) Zone of the City on the hereinabove described real property, subject to the following conditions: 1. That this conditional use permit is granted subject to the completion of Reclassification No. 81-82-5. No building permit shall be issued authorizing any use or building permitted pursuant to this conditional use permit until following adoption of the rezoning ordinance in Reclassification No. 81-82-5. 2. That sidewalks shall be installed along Manchester Avenue and Orangewood Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 4. That prior to commencement of structural framing, fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 5. That subject property shall be served by underground utilities. 6. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 7. That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 8. That the proposed driveway on Orangewood Avenue shall be relocated westerly as approved by the City Traffic Engineer. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4. -3- ...,j~"',,-"~" ~...... 10. That prior to final building and zoning inspections, Condition Nos. 2, 3, 5, 6, 8 and 9, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unen- forceable by the final judgment of any court of competent juris- diction, then this Resolution, and any approvals herein con- tained, shall be deemed null and void.
