84R-036 RESOLUTION NO. 84R -36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 82 -83 -35 to consider an amendment to the Zoning Map referred to in Title 18 of the Anaheim Municipal Code, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and approved the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the Zoning Map referred to in Title 18 of the Anaheim Municipal Code should be amended and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone and zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City Council does hereby declare and indicate its intention to amend the Zoning Map of the City of Anaheim and to rezone and reclassify the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: THAT PORTION OF THE NORTHEAST QUARTER OF SECTION 27, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP FILED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY: -1- 82 -83 -35 COMMENCING AT A POINT IN THE NORTH LINE OF SAID SECTION DISTANT THEREON S. 89 54' 30" W. 620.00 FEET FROM THE NORTHEAST CORNER OF SAID SECTION AS SAID CORNER IS SHOWN ON A MAP FILED IN BOOK 43, PAGE 33 OF RECORD OF SURVEYS IN THE OFFICE OF SAID COUNTY RECORDER; THENCE S. 1 19' 30" E. 265.06 FEET PARALLEL WITH THE EAST LINE OF SAID SECTION TO A LINE THAT IS PARALLEL WITH AND 265.00 FEET SOUTHERLY OF SAID NORTH LINE AND THE TRUE POINT OF BEGINNING; THENCE CONTINUING S. 1 19' 30" E. 388.06 FEET TO SOUTH LINE OF THE NORTH HALF OF SAID NORTHEAST QUARTER; THENCE N. 89 49' 28" E. 619.98 FEET ALONG SAID SOUTH LINE TO THE EAST LINE OF SAID SECTION; THENCE N. 1 19' 30" W. 387.16 FEET ALONG SAID EAST LINE TO SAID PARALLEL LINE; THENCE S. 89 54' 30" W. 620.00 FEET ALONG SAID PARALLEL LINE TO THE TRUE POINT OF BEGINNING. RESERVING THEREFROM THE EASTERLY 45.00 FEET FOR STREET PURPOSES, into the "RM- 1000" RESIDENTIAL, MULTIPLE- FAMILY ZONE of the City of Anaheim, subject to the following conditions: 1. That completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 2462. 2. That completion of these reclassification proceedings is contingent upon completion at Reclassification No. 82- 83 -26. 3. That prior to introduction of an ordinance rezoning subject property, General Plan Amendment No. 185 shall be adopted by the City Council. 4. That an ordinance rezoning subject property shall in no event become effective except upon or following the recordation of a final map within the time specified in Government Code Section 66463.5 or such further time as the Planning Commission or City Council may grant. 5. That prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2, 3 and 4, above - mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date of this resolution, or such further time as the Planning Commission may grant. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 6. 7. That prior to final building and zoning inspections, Condition No. 6, above- mentioned, shall be complied with. -2- BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
