84R-014 RESOLUTION NO. 84R -14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MODIFYING CONDITIONAL USE PERMIT NO. 2342. WHEREAS, the Planning Commission of the City of Anaheim heretofore approved Conditional Use Permit No. 2342 by its Resolution No. PC82 -125 on June 28, 1982, to permit a church and food distribution center on that certain real property situated in the City of Anaheim, County of Orange, State of California, described as: LOT 3 IN BLOCK 1 OF TRACT NO. 304, MILLS PARK TRACT, IN THE CITY OF ANAHEIM, AS PER MAP RECORDED IN BOOK 14, PAGE 50 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. LOT 2 IN BLOCK "1" OF TRACT NO. 304, AS PER MAP RECORDED IN BOOK 14, PAGE 50 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY; and WHEREAS, the Planning Commission of the City of Anaheim heretofore conducted a duly noticed public hearing on November 14, 1983, to determine whether Conditional Use Permit No. 2342 should be revoked or modified upon the grounds said permit was being exercised in a manner contrary to the express terms or conditions of approval; and WHEREAS, after considering all the evidence and testimony offered at said public hearing, the Planning Commission adopted its Resolution No. PC83 -216 revoking Conditional Use Permit No. 2342; and WHEREAS, within the time and manner provided by law, the permittee or other interested party appealed the decision of the Planning Commission to the City Council; and WHEREAS, the City Council on January 10, 1984, did conduct a duly notice public hearing upon said appeal and did receive evidence, both oral and documentary, and did duly consider said decision; and WHEREAS, the City Council does hereby find that said Conditional Use Permit No. 2342 recently has been exercised in a manner contrary to the terms or conditions of such approval and has been so exercised as to be detrimental to the public health or safety, or so as to constitute a nuisance; and WHEREAS, the City Council does hereby find that modification of said Conditional Use Permit No. 2342, including the imposition of additional conditions thereto, is necessary to protect the peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED that the decision of the Planning Commission as expressed in Resolution No. PC83 -216 be, and the same is hereby, vacated and that Conditional Use Permit No. 2342 as heretofore approved by Planning Commission Resolution No. PC82 -125 be, and the same is hereby, modified by eliminating all authorization and approval of outdoor storage therefrom and modifying the conditions of approval as set forth in Resolution No. PC82 -125 in their entirety, to read as follows: 1. That the owner(s) of subject property shall conditionally dedicate to the City of Anaheim a strip of land 40 feet in width from the centerline of the street along Anaheim Boulevard for street widening purposes, conditioned upon the City of Anaheim having a street widening project which includes frontage along subject property. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. 4. That Condition No. 1, above - mentioned, shall be completed within a period of 90 days from the date of this resolution. 5. That trash receptacles are to be stored inside the enclosed building and moved outdoors daily for the purpose of trash truck pickup. 6. That any truck deliveries to the premises shall be limited to Monday through Saturday only and limited to between the hours of 8:00 a.m. and 6:00 p.m. of each such day. 7. That all on -site storage shall be located within the enclosed building only and such storage shall be limited to dry products and canned goods only. 8. That there shall be no processing of the food products stored on -site. 9. That there shall be no use of the premises for sleeping purposes or living quarters. 10. That this permit shall expire on July 10, 1984.
