84R-007 RESOLUTION NO. 84R -7
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE TERMS AND CONDITIONS OF AN
AGREEMENT TO BE ENTERED INTO WITH CONTRACTORS EMPLOYED
IN EMERGENCY SITUATIONS REQUIRING IMMEDIATE WORK ON
THE CITY UTILITY SYSTEMS, AND AUTHORIZING THE PUBLIC
UTILITIES GENERAL MANAGER TO NEGOTIATE THE
CONTRACTOR'S FEES AND TO EXECUTE SAID AGREEMENT.
WHEREAS, from time to time, the City of Anaheim
requires the services of an independent contractor to assist
the City in emergency circumstances when the City has an
insufficient number of personnel to maintain and /or restore
service during such emergency; and
WHEREAS, the City desires to expedite the securing of
services of contractors having sufficient manpower to assist
the City during such emergencies; and
WHEREAS, an Agreement has been prepared, the terms and
conditions of which are acceptable to the City Council of the
City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Anaheim that the terms and conditions of said
Agreement are hereby approved and accepted, and the Public
Utilities General Manager is authorized to negotiate the
Contractor's Fees and to execute said Agreement on behalf of
the City of Anaheim, subject to the following conditions:
(1) that there are sufficient funds in the current
Resource Allocation Plan to compensate contractors
for services performed; and
(2) an emergency, in the opinion of the Public
Utilities General Manager, exists to such an
extent that the City of Anaheim Public Utilities
Department does not have a sufficient number of
personnel to maintain and /or restore service
during such emergency; and
(3) The term of any said agreement signed by the
General Manager or his designated representative
shall expire on the date of the next regular city
council meeting. At said meeting, the General
Manager or his designated representative shall
submit to the City Council a report showing actual
and estimated expenditures for the emergency
services.

THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 10th day
of January , 1984.
