A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIMIFINDING AND DETERMINING THAT PUBLIC
CONVENIENC~ AND NECESSITY REQUIRE THE CONSTRUC-
TION AND COMPLETION OF A PUBLIC IMPROVEMENT,
TO WIT:
LEMON STREIT STORM DRAIN, COMMERCIAL STREET TO
ANAHEIM BO LEVARD IN THE CITY OF ANAHEIM,
ACCOUNT NO . 24-791-6325-E1290,
17-791-632 -E1290, 51-606-6329-02264 EDA PROJECT
07-01-0272 .
WHEREAS, ppblic convenience and necessity require the
construction and completion of a public improvement in the City of
Anaheim, to wit:
Lemon Street Stprm Drain Commercial Street to Anaheim
Boulevard in th~ City of Anaheim, consisting of
construction of! 66" through 18" R.C.P.; 8" V.C.P. and
laterals; P.C.C~ structures including catch basins,
manholes, junct~on structures, 6'-3" x 3'-3" R.C.B.
structure, curb! and gutter, A.C. pavement, A.C.
removal, aggregi'te base material; 6" and 8" D.I.P
waterline sipho s; sheeting, shoring and bracing and
all other work hown on the plans and delineated in the
specifications t'n file in the Office of the City
Engineer, Accou t Nos. 24-791-6325-E1290,
17-791-6325-E120, 51-606-6329-02264 EDA PROJECT

WHEREAS, t~e City Council instructed the Public Works
Department to prepar, detailed designs, plans, profiles, drawings
and specifications, ~nd estimates of quantities and costs and make
necessary surveys fot the construction of said public improvement;
and

WHEREAS, s~id Public Works Department has prepared said
detailed designs, pl,ns, profiles, drawings and specifications for
the construction of ~aid public improvement and has submitted the
same to the City Council; and
WHEREAS, t~e City Council finds that said detailed
designs, plans, profiles, drawings and specifications for said
public improvement a~ove mentioned, are in accordance with good
engineering practice, and are adequate to serve the needs and
requirements of the City of Anaheim and the citizens and residents
in said area for the purposes for which they are intended, and that
they are adequate fOf the construction of said public improvement
and should be approved.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the detailed designs, plans, profiles,
drawings and specifitations for said public improvement hereinabove
mentioned and descriped be, and the same are hereby, approved and
adopted as prepared by said Public Works Department.

BE IT FURTaER RESOLVED that said public improvement shall
be constructed in ac~ordance with said detailed designs, plans,
profiles, drawings and specifications as prepared by said Public
Works Department and hereby approved, and such addenda or
modifications theret~ as may be approved prior to the awarding of
bids therefor.
BE IT FURTfER RESOLVED that the City Clerk of the City of
Anaheim be, and she ,s hereby, authorized and directed to publish a
notice according to law, inviting sealed proposals for the
furnishing of all pl~nt, labor, services, materials and equipment,
and all utilities an~ transportation, including power, fuel and
water, and performing all work necessary to construct and complete,
in a good and workma~like manner, in strict accordance with said
detailed designs, pl.ns, profiles, drawings and specifications as
prepared by said Public Works Department, the public improvements
hereinabove mentione~ and described, and fixing the 17th day of
January, 1985, at the hour of 2:00 o'clock P.M. as the date and
hour for the opening of said bids at the City Council Chamber in
the City Hall in the City of Anaheim, and that said notice shall be
published twice, the first of which publications shall be at least
ten (10) days prior to the date fixed for the opening of bids, and
that said publications shall be at least five (5) days apart.
BE IT FURTHER RESOLVED that the successful bidder or
bidders shall be req~ired to enter into a contract with the City of
Anaheim in the mannet and form approved by the City Attorney of the
City of Anaheim for the construction, installation and completion
of said public improvement hereinabove mentioned and described, in
accordance with the plans and specifications prepared by said
Public Works Departm~nt, the notice inviting sealed proposals, this
resolution and all applicable City Ordinances or Code Sections and
the laws of the State of California, and shall be required to post
bonds and insurance in the amounts and within the time required by
law, as specified in the notice inviting sealed proposals, and in a
form approved by the City Attorney.
