City Copncil of the City of Anaheim did cause to be publishef:'il in a ne~spaper of general circulation, published and circul~ted in tbe City of Anaheim, to wit: The Anaheim Bulletin, on! ithe 6th and 21st days of June, 1984, inviting sealed proposals for! furnishing the following: All plant, labor!, servicel'3, materials and equipment, and all utilities a~',".".'.' transpo~,.'.' tation, including power, fuel and water, and . rforming all work necessary to construct and complete in I! good and workmanlike manner, in strict accordance with ~e specifications, plans and drawings therefor on fileiin the Office of the City Engineer or City Clerk of th~ City of Anaheim, the following public improvement, to wit: ,~ Central City Str~et Improvement within an area bounded by Sycamore Street,! !Sabrina Street, Cypress Street and Anaheim Boulevar~, in the City of Anaheim, and consisting of clearing and srubbing; excavation; construction of P.C.C. curb, gu~er, sidewalk, access ramps, driveway and alley approach, ~nd cross gutter and apron: construction of asphalt conc~te: adju:stment of manholes, cleanouts, water valve boxels and survey monuments to grade; relocation of si~ns: removal of concrete pavement: remove water sleeve: cqnstruction and reconnection of water service: reloca~ion of fire hydrant: and all appurtenant work as shown oQ the plans and delineated in the specifications qn file in the office of the City Engineer, Accou~t Nos. 25-793-6325-E3780 and 51-606-6329-17540-34310, in accordance with ijhe designs, plans, profiles and specifications prepared by the pub~ic Works Department, and the notice inviting sealed proposals, w~ich said notice specified that sealed r .......... .~, proposals as specifi.d in said notice would be received up until 2:00 o'clock P.M. on the 5th day of July, 1984, and which said notice did state andideclare that, pursuant to the provisions of Section 1770 of the ~bor Code, the City Council of the City of Anaheim had ascertai~ed the prevailing rate of wages for each type of labor needed to e*ecute said contract, and did state that the prevailing hourly wa9~ scale so ascertained was on file in the Office of the City C~erk: and WHEREAS, on! the 5th ~ay of July, 1984, at the hour of 2:00 o'clock P.M., t~e City Clerk and the City Engineer of the City of Anaheim did ~~en said sealed proposals received up to that time for the furnish~ng of all plant, labor, services, materials and equipment, and a~l utilities and transportation, including power, fuel and watet, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance wi~h the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public ~$provement hereinabove more particularly described and set fotth, in public, in the City Council Chamber in the City Hall, Anahel$, California, and the City Engineer did tabulate the result ~f said sealed proposals and did make a report to the City Council at a meeting held no later than thirty (30) days after the bids ~ere opened; and WHEREAS, th, City Council of the City of Anaheim did, at a subsequent regularior adjourned regular meeting, held on the 24th day of July, 19'4, at the hour of 10:00 o'clock A.M., consider the sealed p~oposals submitted for furnishing the materials and perfor~~ng the work hereinabove more particularly described and set fotth, and did thereupon find and determine that the sealed proposal ,ubmitted by WALSH ENGINEERING COMPANY, 1124 N. Richfield Road, ~aheim, California 92807 for the construction, installation and comp1etion of said Central City Street Improvement, Area Bopnded by Sycamore Street, Sabrina Street, Cypress Street, and ~aheim Boulevard, in the City of Anaheim, Account Nos. 25-793-~325-E3780 and 51-606-6329-17540-34310 hereinabove mentione~ and described, was the lowest responsible proposal submitted t~erefor, and thereupon accepted said bid and did award a contract to said contractor for furnishing all plant, labor, services, materials and equipment and all utilities and transportation, incl~ding power, fuel and water, and performing all work necessary tp construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings, the said public improvement as specified in said notice inviting sealed proposals, and did authorize the Mayor .~ and the City Clerk ot the City of Anaheim to execute a contract for and on behalf of the City of Anaheim with said contractor, which said contract was duly made and entered into on the 21st day of August, 1984: and J I"" ,-.. .,.-." WHEREAS, th, said contractor has furnished all plant, labor, services, mat,~ials and equipment and all utilities and transportation, and r~rformedall work necessary for the construction and comp~etion, in a good and workmanlike manner, in strict accordance wi~h the specifications, plans and drawings of said public improvem~nt as specified in the notice inviting sealed proposals and in theidetailed designs, plans, drawings and specifications prepated by the Public Works Department, and the contract made and entered into with said contractor by the City of Anaheim: and WHEREAS, th~ Public Works Executive Director has duly certified to the coni'truction and completion of said public improvement hereinab~. e mentioned and described, in accordance with the plans and s ,cificatlons and the contract documents duly made and entered int, · with said contractor: and WHEREAS, th, City Council finds that said contractor has completed said publif improvement hereinabove more particularly described in accorda*~e with the provisions of the contract and the contract documents, and that notice of completion should be filed and payment of the balance due said contractor authorized in accordance with the contract documents. NOW, THEREF~~E, BE IT RESOLVED by the City Council of the City of Anaheim thati~ll plant, labor, services, materials and equipment and all ut~lities and transportation, and the performance of all w~fk necessary to construct, install and complete in a good a'~ workmanlike manner, in strict accordance with the specificati~ns, plans and drawings therefor on file in the Office of the City Clerk ~f the City of Anaheim, together with the appurtenances th,feto, said public improvement hereinabove more particularly de$cribed and set forth, in the City of Anaheim, by said contractor, ~e, and the same are hereby, accepted subject, nevertheless, to all the terms, conditions and provisions of the contract documents, .nd that the balance due said contractor for said work be paid to' said contractor thirty-five (35) days from and after final acceptance of said work as evidenced by the adoption of this res~lution, but not sooner than thirty (30) days after the date of th. filing of notice of completion, excepting only such sum or sums as may lawfully be withheld in accordance with the provisions ~f said contract and contract documents. That acceptance by the co.tractor of said payments made in accordance with said final esti,ate shall operate and shall be a release to the City of Anaheim, its officers, agents and employees from all claims and liabiliti~s due the contractor for anything done or .-., furnished or withhel~ or for anything relating to the work or any act or neglect of th. City, its officers, agents and employees, excepting only claim$ against the City for amounts withheld by the City at the time of such payment. ~ i r' .-..
