WHEREAS,i the City Council of the Ci ty of Anaheim did
cause to be pUblited in a newspaper of general circulation,
published and cir ulated in the City of Anaheim, to wit: The
Anaheim Bulletin, on the 25th day of October and the 1st day of
November, 1984, a Inotice inviting sealed proposals for furnishing
the following: '
All plant, l~bor, services, materials and equipment,
and all util'ties and transportation, including power,
fuel and wat r, and performing all work necessary to
construct an complete in a good and workmanlike
manner, in s~rict accordance with the specifications,
plans and dr4wings therefor on file in the Office of
the City Eng~neer or City Clerk of the City of Anaheim,
the followin~ public improvement, to wit:
Construction:of a restroom building at La Palma Park,
in the City ~f Anaheim, including but not limited to:
site work, c~ncrete, masonry, carpentry, roofing,
plaster, pai*ting, doors and sky lights, plumbing,
electrical, ~tc., and all appurtenant work thereto, as
shown on the1plans, and delineated in the
specificatio~S on file in the Office of the City

WHEREAS~ said notice inviting sealed proposals for said
public improvement did provide that sealed proposals would be
received by the CJty of Anaheim at the Office of the City Clerk of
the City of Anahe~m up to the hour of 2:00 o'clock P.M. on the 15th
day of November, ~984, for the furnishing of all plant, labor,
services, materia~s and equipment, all utilities and
transportation, including power, fuel and water, and performing all
work necessary to construct and complete in a good and workmanlike
manner, the publip improvement hereinabove more particularly
mentioned and desbribed, and which notice did state and declare
that pursuant to ~he provisions of Section 1770 of the Labor Code,

the City Council qf the City of Anaheim had ascertained the
prevailing rate O~ wages in the locality in which this type of
labor is to be pe formed for each craft or type of workman or
mechanic needed t . execute the contract, and which wage scale is on
file in the offic~s of the City Clerk and City Engineer~ and

WHEREAS,i the Ci ty Clerk of the Ci ty of Anaheim did
receive the fOllO~ing sealed proposals prior to 2:00 o'clock
on the 15th day 0 November, 1984, in response to the notice

AND WHE~S' the City Engineer did thereupon examine and
tabulate said sea ed proposals and did report to the City Council
the result of his ,examination and tabulation~ and
WHEREAS,I the City Council finds that the sealed proposal
submitted by Gorh~m Company, Inc., 1404-A S. Ritchey, Santa Ana,
California 92705, lis the lowest responsible proposal submitted for
the furnishing of lall plant, labor, services, materials and
equipment, all ut~lities and transportation, including power, fuel
and water and per~rming all work necessary to construct and
complete in a goo~ and workmanlike manner, in strict accordance
with the specific~tions, plans and drawings therefor on file in the
Office of the Cit~ Clerk of the City of Anaheim, the public
improvement hereiqabove mentioned and described, together with the
appurtenances the~eto, and as specified in the notice inviting
sealed proposals, :and that said proposal of said above-named bidder
should be accepte~ and a contract awarded to said bidder in
accordance therew~th~ and

WHEREAS,; the ci ty Council finds that the above-mentioned
sealed proposal i~ the lowest responsible proposal received and
that the person, ~irm or corporation submitting said proposal is a
responsible perso~, firm or corporation and that the proposal
submitted is the ~est suited and fitted for the public improvement
to be constructed.

NOW, TH~REFORE, BE IT RESOLVED by the City Council of the
City of Anaheim t~at the sealed proposal submitted by said
contractor for th~ furnishing of all plant, labor, services,
materials and equ~pment, all utilities and transportation,
including power, ~el and water, and performing all work necessary
to construct and qomplete, in a good and workmanlike manner, in
strict accordance iwith the specifications, plans and drawings
therefor on file ~n the Office of the City Clerk of the City of
Anaheim and the ndtice inviting sealed proposals, the public works
and improvement h~reinabove more particularly mentioned and
described, togeth~r with the appurtenances thereto, be, and the
same is hereby, aqcepted, and that a contract for the construction
and completion of isaid public improvement be, and the same is
hereby, awarded t~ the said above-named bidder.
AND BE ~T FURTHER RESOLVED that the successful bidder or
bidders upon each icontract awarded as hereinabove set forth, shall
be, and they are ~ereby required to execute a contract in the
required form wit~ the City of Anaheim upon the terms and
conditions specif~ed in the notice inviting sealed proposals and
the proposal subm~tted by said successful bidder or bidders and in
accordance with t~e plans and specifications for said public
improvement herei1above described, and in accordance with the
terms, conditions :and provisions of this resolution, and that said
successful bidder lor bidders to whom each contract is awarded shall
be required to fu~nish a surety bond in an amount equal to one
hundred percent (~OO%) of the contract price for all labor,
materials and equ~pment to be furnished and performed, as set forth
in the sealed pronosal submitted by said bidder for the
construction of s~id public improvement, together with the
appurtenances the~eto or such portion thereof as is covered by said
contract, as secu~ity for the faithful performance of said
contract, and a s~parate surety bond in an amount equal to one
hundred percent (~OO%) of the construction cost of said public
improvement cover~d by said contract, as security for the payment
of all persons pe~forming labor and furnishing material for said
project.

AND BE ~T FURTHER RESOLVED that said successful bidder
bidders be, and t~ey are hereby, required to furnish to the City
Anaheim in compan~es satisfactory to the City of Anaheim, public
liability, proper~y damage, compensation, and other insurance in
the amounts and fqr the purposes set forth and specified in the
notice inviting s~aled proposals, and subject to the approval of
the City Attorney 'as to form and sufficiency.
AND BE ~T FURTHER RESOLVED that the Mayor and the City
Clerk of the Cityiof Anaheim be, and they are hereby, authorized
and directed to m~ke, execute and enter into, for and on behalf of
the City of Anahe~m, a written contract with said successful bidder
or bidders for th~ furnishing of all plant, labor, materials, and
equipment and performing all work, as hereinabove more particularly
described, for th~ construction, installation and completion of
said public impro~ement hereinabove described upon the terms and

conditions as speqified in the notice inviting sealed proposals,
the detailed design, plans, profiles, drawings and general
specifications an~ detailed specifications and drawings, and all
addenda thereto, ard all modifications incorporated therein prior
to the date of thej opening of bids, on file in the Office of the
City Clerk of the Fity of Anaheim and in strict accordance with the
terms, conditions land provisions of this resolution, and in
accordance with a~l of the contract documents herein specified.
THE FOR~OING RESOLUTION is approved and adopted by the
City Council of tHe City of Anaheim this 4th day of December, 1984.
