NAME TOTAL PRICE Damon Construction C~~pany Frontier Concrete Co~truction Walsh Engineering Co pany Industrial Fence andrSupply Nobest, Inc. $45,776.00 $48,561.57 $55,378.40 $56,948.40 $69,105.65 AND WHEREA$i, the Ci ty Engineer did thereupon examine and tabulate said Sealed!, ~roposals and did report to the City Council the result of his ex~~ination and tabulation; and WHEREAS, tp~ City Cpuncil finds that the sealed proposal submitted by DAMON C~STRUCTlPN COMPANY, 5871 Firestone Boulevard, South Gate, CA 90280~. is the 10west responsible proposal submitted for the furnishing o~ all plapt, labor, services, materials and equipment, all utili~lies and transportation, including power, fuel and water and perfor~ing all work necessary to construct and complete in a good a~d workmaplike manner, in strict accordance with the specificatibns, plans and drawings therefor on file in the Office of the City C~erk of the City of Anaheim, the public improvement hereinabp~e mentioned and described, together with the appurtenances theretp" and as speci fied in the notice inviting sealed proposals, antr that said proposal of said above-named bidder should be accepted and a contract awarded to said bidder in accordance therewithb and WHEREAS, t~e City Council finds that the above-mentioned sealed proposal is t~~ lowest responsible proposal received and that the person, fir~ or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. NOW, THEREfORE, BE IT RESOLVED by the City Council of the City of Anaheim that the sealed proposal submitted by said .~ contractor for the f~rnishing of all plant, labor, services, materials and equipm~t, all utilities and transportation, including power, fue!1 and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of f' -.... Anaheim and the noti~e inviting sealed proposals, the public works and improvement hereinabove more particularly mentioned and described, together .~th the .ppurtenances thereto, be, and the same is hereby, accet~ed, and that a contract for the construction and completion of sa ~ public improvement be, and the same is .~ hereby, awarded to ti~ said above-named bidder. AND BE IT t~RTHER ~SOLVED that the successful bidder or bidders upon each co,tract aw~rded as hereinabove set forth, shall be, and they are her.by requited to execute a contract in the required form with t.~ City of Anaheim upon the terms and conditions specified in the n~tice inviting sealed proposals and the proposal submitt,~ by saicli successful bidder or bidders and in accordance with the flans and specifications for said public improvement hereinab~ve described, and in accordance with the terms, conditions an' provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furni~o a surety bond in an amount equal to one hundred percent (100.'> of the contract price for all labor, materials and equipm,nt to be furnished and performed, as set forth in the sealed propos~~ submitted by said bidder for the construction of said! public i~provement, together with the appurtenances theret~ or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a sepatate surety bond in an amount equal to one hundred percent (100.'> of the construction cost of said public improvement covered b~ said contract, as security for the payment of all persons perfo~~ing labor and furnishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they: are hereby, required to furnish to the City of Anaheim in companies: Isatisfactory to the City of Anaheim, public liability, property ~~mage, cpmpensation, and other insurance in the amounts and for ~he purposes set forth and specified in the notice inviting seal~ proposals, and subject to the approval of the City Attorney as'to form and sufficiency. ....-..." AND BE IT ,uRTHER ~SOLVED that the Mayor and the City Clerk of the City of'Anaheim be, and they are hereby, authorized and directed to makei, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bidder or bidders for the fqrnishing of all plant, labor, materials, and equipment and perfor~ing all work, as hereinabove more particularly described, for the construction, installation and completion of said public improve~nt hereinabove described upon the terms and condi tions as speci flied in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifications and d~tailed s~ecifications and drawings, and all addenda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the Ci ty Clerk of the Ciity of Anaheim and in strict accordance with the 1 ~ f!" ~ terms, conditions and provisions of this resolution, and in accordance with all ~f the contract documents herein specified.
