RESOLUTION NO. 84R-420
A RESOL~ION OF THE CITY COUNCIL OF THE
CITY OF ~AHEIM TERMINATING A CONTRACT
WITH A ~ A PIPELINE, INC.
/~
WHEREAS, the ~ity Council did on March 20, 1984, adopt
Resolution No. 84R-lO~ awarding a contract for construction of
water mains in Brookh~rst Street to A & A Pipeline, Inc.
("CONTRACTOR"): and .
WHEREAS, CON~RACTOR commenced work on said project: and
WHEREAS, Cit~' has been advised by the Insurance
Commissioner of the c ncellation of the labor and material bonds
and faithful performa ce bonds posted with City by CONTRACTOR:
and
WHEREAS, CON1RACTOR has failed, after ten days notice,
to provide bonds to r~place the cancelled bonds: and
WHEREAS, CON~RACTOR has advised City that CONTRACTOR is
unable, due to financ~al problems, to complete the project: and
WHEREAS, the ,prompt completion of project is necessary
to the health, safety~ and welfare of the citizens of Anaheim:
and
WHEREAS, thi~ project is for the extension and
expansion of the tran~mission and distribution of water.
NOW, THEREFO~, BE IT RESOLVED by the City Council of
the City of Anaheim t~at:
1. A & A P~peline, Inc., is hereby declared in
default of its perfor.ance of the contract.
2. The con~ract with A & A Pipeline, Inc., is hereby
terminated pursuant t~ Sections 18 and 21 of said contract.

3. The Citt Engineer be and he is hereby authorized
to complete or cause ~o be completed the work remaining on
Project for the accou$t and at the expense of A & A Pipeline,
Inc., and the City Entineer may take possession of and utilize
such materials applia+ce and plant as may be on the site of the
work and necessary th+refor.
