84R-415 .- ~ RESOLUTION NO. 84R-4l5 A RESOLUTIO~ OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ~TING CONDITIONAL USE PERMIT NO. 2612. .,.-.,. WHEREAS, ~h J City Planning Commission of the City of Anah.eim did receive a application for a conditional use permit from EDWARD L. SCAN and PATRICIA B. SCANLAN, owners, to permit a board and care faci ity for a maximum of fifteen (15) adults upon certain real pro~erty located within the City of Anaheim, County of Orange, Sta~e of California, legally described as: LOT 18 OF TACT Nq. 2723, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE,j STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOKIs4 PAGES 19 TO 21 INCLUSIVE OF MISCELLANEOUS MA~S, IN THE OFFICE OF THE COUNTY RECORDER OF SAIDICOUNTY; and WHEREAS, th~ City Planning Commission did hold a public hearing upon said app~ication at the City Hall in the City of Anaheim, notices of w~ich public hearing were duly given as required by law and tije provisions of Title 18, Chapter 18.03 of the Anaheim Municipal 'Code; and WHEREAS, said Commission, after due inspection, investigation and stu ies made by itself and in its behalf and after due considerati n of all evidence and reports offered at said hearing, did ado~t its Resolution No. PC84-l70 granting Conditional Use Permit No. 2612; and WHEREAS, thtreafter, within the time prescribed by law, an interested party 0 the City Council, on its own motion, caused the review of .aid Planning Commission action at a duly noticed public hearin~; and WHEREAS, at the time and place fixed for said public hearing, the City Cou.cil did duly hold and conduct such hearing and did give all pers~ns interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, th, City Council finds, after careful consi- deration of the recom~endations of the City Planning Commission and all evidence and reports offered at said hearing, that: .~ 1. The propose~ use is properly one for which a conditional use permit is authori~ed by the Anaheim Municipal Code. - I ~ 2. The proposeQ use will not adversely affect the adjoin- ing land uses and the igrowth and development of the area in which it is proposed to be ~cated. 3. The size anq shape of the site proposed for the use is ,~ adequate to allow the !full development of the proposed use in a manner not detrimenta~ to the particular area nor to the peace, health, safety and ge~eral welfare. 4. The traffic igenerated by the proposed use will not impose an undue burde~ upon the streets and highways designed and improved to carry the 'traffic in the area. 5. The grantin~ of the conditional use permit under the conditions imposed wi~l not be detrimental to the peace, health, safety and general we~fare of the citizens of the City of Anaheim. NOW, THEREFqRE, BE IT RESOLVED by the City Council of the City of Anaheim t~at, for the reasons hereinabove stated, the action of the City Pl~nning Commission granting said conditional use permit be, and th~ same is hereby, modified and that Conditional Use Permi~ No. 2612 be, and the same is hereby, granted permitting a ~oard and care facility for a maximum of fifteen (l5) adults oQ the hereinabove described real property, subject to the follow~ng conditions: 1. ~ That trash ~torage areas shall be provided in accordance with approved plans on file with the Street Maintenance!and Sanitation Division. 2. That the eXisting structure shall be brought up to the minimum sta dards of the City of Anaheim, including the Uniform Buiding, Plumbing, Electrical, Housing, Mechanical 4nd Fire Codes as adopted by the City of Anaheim. 3. That the prqposal shall comply with all signing requirement~ of the RM-1200 Zone, unless a variance allowing si~n waivers is approved by the Planning Commission ~r City Council. 4. That no mor. than three (3) resident-owned vehicles shall be pa*ked and stored on-site. 5. That the ma*imum occupancy for this facility shall be limited to ~nd shall not exceed fifteen (15) older adult resid.nts plus one (1) couple for management and housekeepin~ duties. ~ - 6. That subject proeprty shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. land 2. 7. That prior tp the commencement of the activity authorized u~er this resolution, or final building and zoning inspeptions, whichever occurs first, Condition Nos. l, 2 an~ 6, above-mentioned, shall be complied with. .--.. BE IT FURTHE~' RESOLVED that the City Council does hereby find and determ'ne that adoption of this Resolution is expressly predicated u n applicant's compliance with each and all of the conditions. ereinabove set forth. Should any such conditions, or any par~ thereof, be declared invalid or unenforceable by the f~nal judgment of any court of competent jurisdiction, then thi~ Resolution, and any approvals herein contained, shall be de~med null and void.
