WHEREAS, fe City Council of the City of Anaheim did cause to be publish in a newspaper of general circulation, pUblished and circu ted in the City of Anaheim, to wit: The Anaheim Bulletin, 0 the 6th and 13th days of September, 1984, a notice inviting seal d proposals for furnishing the following: All plant, lab~, services, materials and equipment, and all utilitijes and transportation, including power, fuel and water,! and performing all work necessary to construct and cpmplete in a good and workmanlike manner, in stri~t accordance with the specifications, plans and drawi~gs therefor on file in the Office of the City Engine~r or City Clerk of the City of Anaheim, the following ppblic improvement, to wit: Patrick Henry N~ighborhood street and storm drain improvements, ~st Street-Romneya Drive to Carbon Creek Channel; RomneY~' Drive-Citron Lane to West Street, in the City of Ana eim, consisting of clearing and grubbing; excav tion; construction of P.C.C. curb and gutter, sidewal , driveways, access ramps, A.C. pavement; tree ~emoval; construction of 42" R.C.P. through 18" R.C~P. storm drain system, including laterals, catchibasins, manholes and other structures; relocation of w~ter services and all other appurtenant work in place i~ accordance with the project plans and specifications pn file in the office of the City Engineer, ACCOU!'t Nos. 25-79l-6325-E1320, 25-792-6325-E29 0, 25-792-6325-E29BO and 51-606-6329-0070, --... in accordance with t~e design, plans, profiles and specifications of said public impro ement on file in the Office of the City Clerk of the City of Anahe. m; and ~, .-"'. .."..,..... WHEREAS, ~id notice inviting sealed proposals for said public improvement ~id provide that sealed proposals would be received by the Cit~ of Anaheim at the Office of the City Clerk of the City of Anaheim lup to the hour of 2:00 o'clock P.M. on the 27th day of November, 19~, for the furnishing of all plant, labor, services, materials ~nd equipment, all utilities and transportation, inc~ding power, fuel and water, and performing all work necessary to c~struct and complete in a good and workmanlike manner, the public i~provement hereinabove more particularly mentioned and descri~ed, and which notice did state and declare that pursuant to th~ provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be perf~med for each craft or type of workman or mechanic needed to ~ecute the contract, and which wage scale is on file in the offices of the City Clerk and City Engineer; and WHEREAS, the City Clerk of the City of Anaheim did receive the followi~ sealed proposals prior to 2:00 o'clock P.M. on the 27th day of S~ptember, 1984, in response to the notice aforesaid inviting s~aled proposals, to wit: NAME TOTAL PRICE GILLESPIE CONSTRUCTlPN, INC. . . . . . . $441,384.80 WALSH ENGINEERING CO~ANY. . . . . . . .. . $464,165.00 LOANT CONSTRUCTION .'. . . . . . . . . . $481,192.00 SHULER ENGINEERING ',' . . . . . . . . . . . $495,154.85 SULLER-MILLER CONTRAPTING COMPANY. . . .. . $514,384.00 COLICH AND SONS . . . . . . . . . . . . $541,140.50 VICCO CONSTRUCTION . . . . . . . . . . .. . $543,350.00 KERSHAW CONSTRUCTIONI. . . . . . . . $546,260.00 IVAN BACHAN CONSTRUC~ION . . . . . . . . . . $569,532.00 FLEMING ENGINEERING, INC. ........... $626,406.90 RICHARDSON & LE BOUEF, INC. . . . . .. $715,669.50 AND WHEREA~, the City Engineer did thereupon examine and tabulate said sealed! proposals and did report to the City Council the result of his ex~mination and tabulation; and - WHEREAS, tpe City Council finds that the sealed proposal submitted by GILLESP~E CONSTRUCTION, INC., 3004 Deddar, Suite D, Costa Mesa, Californ~a 92626, is the lowest responsible proposal submitted for the fu~nishing of all plant, labor, services, materials and equipm~nt, all utilities and transportation, including power, fue~ and water and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notJce inviting sealed proposals, and that said proposal of said abo~e-named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and -2- .-. ....... .,_. WHEREAS, ~he City Council finds that the above-mentioned sealed proposal is ~he lowest responsible proposal received and that the person, fitm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. NOW, THER~FORE, BE IT RESOLVED by the City Council of the City of Anaheim tha~ the sealed proposal submitted by said contractor for the ~urnishing of all plant, labor, services, materials and equip~ent, all utilities and transportation, including power, fu~l and water, and performing all work necessary to construct and co~plete, in a good and workmanlike manner, in strict accordance w~th the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim and the nottce inviting sealed proposals, the public works and improvement hereinabove more particularly mentioned and described, together 'with the appurtenances thereto, be, and the same is hereby, acce,pted, and that a contract for the construction and completion of s~id public improvement be, and the same is hereby, awarded to the said above-named bidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each cqntract awarded as hereinabove set forth, shall be, and they are her~by required to execute a contract in the required form with the City of Anaheim upon the terms and condi tions speci fied! in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said public improvement hereinabbve described, and in accordance with the terms, conditions antl provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furni~h a surety bond in an amount equal to one hundred percent (100~> of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as securit~ for the faithful performance of said contract, and a sepa~ate surety bond in an amount equal to one hundred percent (lOOt> of the construction cost of said public improvement covered by said contract, as security for the payment of all persons performing labor and furnishing material for said project. -. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim, public liability, property ~amage, compensation, and other insurance in the amounts and for the purposes set forth and specified in the notice inviting seal.d proposals, and subject to the approval of the City Attorney as to form and sufficiency. -3- ,-. ~. .-. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to mak$, execute and enter into, for and on behalf of the City of Anaheim~ a written contract with said successful bidder or bidders for the ~~rnishing of all plant, labor, materials, and equipment and perfo~ming all work, as ~ereinabove more particularly described, for the qOnstruct~on, installation and completion of said public improve~$nt hereinabove described upon the terms and conditions as speci~ied in the notice inviting sealed proposals, the detailed design; plans, profiles, drawings and general specifications and detailed specifications and drawings, and all addenda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified. THE FOREGqING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 16th day of October, 1984.
