A RESOLUT~QN OF THij CITY COUNCIL OF THE CITY
OF ANAHEI~,FINDINGAND DETERMINING THAT PUBLIC
CONVENIENQE AND NECESSITY REQUIRE THE CONSTRUCTION
AND COMPLatIoN OF A PUBLIC IMPROVEMENT, TO WIT:
REHABILIT~TION OF WELLS NOS. 106 AND 128 AND
DEMOLITION OF WELL NO. 108 AND WELL AT MARSHALL
PARK, IN 1$E CITY OF ANAHEIM, ACCOUNT NOS.

WHEREAS, n~blic convenience and necessity require the
construction and co~~letion of a public improvement in the City of
Anaheim, to wit:
Rehabilitation consisting of Well Nos. 128 and 108 and
demolition of W~llNo. 108 and Well at Marshall Park in
the City of An~heim, including the construction of a
control buildirlg, replacement of pumps and motors,
construction o~control switchgear, and installation of
SCADA systems; and demolition of two other wells
including remo~al ofpumps and motors, site restoration,
and removal of chemical injection equipment according
to the plans and specifications on file in the Office
of the City En~~neer Account Nos. 53-619-6329-02375 For
Well #106, 53-619-6329-02384 for Well #128,
53-619-6329-02398 for Well #108 and 51-619-6329-02404
for Well at Marshall Park; and
WHEREAS, ~he City Council instructed the Public Works
Department to prepa~e detailed designs, plans, profiles, drawings
and specifications, and estimates of quantities and costs and make
necessary surveys for the construction of said public improvement;
and
WHEREAS, ~aid Public Works Department has prepared said
detailed designs, p~ans, profiles, drawings and specifications for
the construction of said public improvement and has submitted the
same to the City Co~ncil; and

WHEREAS, ~he City Council finds that said detailed
designs, plans, pro~.les, drawings and specifications for said
public improvement ~bove mentioned, are in accordance with good
engineering practicd and are adequate to serve the needs and
requirements of the City of Anaheim and the citizens and residents
in said area for the purposes for which they are intended, and that
they are adequate for the construction of said public improvement
and should be approved.

NOW, THER$fORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the detailed designs, plans, profiles,
drawings and specifications for said public improvement hereinabove
mentioned and described be, and the same are hereby, approved and
adopted as prepared by said Public Works Department.
BE IT FUR18ER RESOLVED that said public improvement shall
be constructed in aCdordance with said detailed designs, plans,
profiles, drawings a~d specifications as prepared by said Public
Works Department and hereby approved, and such addenda or
modifications thereto as may be approved prior to the awarding of
bids therefor.
BE IT FUR~aER RESOLVED that the City Clerk of the City of
Anaheim be, and she is hereby, authorized and directed to publish a
notice according to law, inviting sealed proposals for the
furnishing of all pLant, labor, services, materials and equipment,
and all utilities aqd transportation, including power, fuel and
water, and performins all work necessary to construct and complete,
in a good and workm~like manner, in strict accordance with said
detailed designs, pl~ns, profiles, drawings and specifications as
prepared by said Pub1.ic Works Department, the public improvements
hereinabove mentione~ and described, and fixing the 15th day of
November, 1984, at the hour of 2:00 o'clock P.M. as the date and
hour for the opening of said bids at the City Council Chamber in
the City Hall in the City of Anaheim, and that said notice shall be
pUblished twice, the first of which publications shall be at least
ten (10) days prior to the date fixed for the opening of bids, and
that said publications shall be at least five (5) days apart.
BE IT FURT~R RESOLVED that the successful bidder or
bidders shall be reqpired to enter into a contract with the City of
Anaheim in the manne~ and form approved by the City Attorney of the
City of Anaheim for the construction, installation and completion
of said public improvement hereinabove mentioned and described, in
accordance with the plans and specifications prepared by said
Public Works Departm~nt, the notice inviting sealed proposals, this
resolution and all applicable City Ordinances or Code Sections and
the laws of the State of California, and shall be required to post
bonds and insurance in the amounts and within the time required by
law, as specified in the notice inviting sealed proposals, and in a
form approved by the City Attorney.

THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 9th day of October, 1984.
