A RESOLUTION fF THE CITY COUNCIL OF THE CITY OF ANAHEIM CERTI YING THE INITIAL STUDY WITH RESPECT TO THE PROPOS D DISPOSITION AND DEVELOPMENT AGREE- MENT BETWEEN HE ANAHEIM REDEVELOPMENT AGENCY AND MARY FERGUSONr DEVELOPER; FINDING THAT THE CON- SIDERATION FO~ THE SALE OF THE PROPERTY THEREUNDER IS NOT LESS ~HAN FAIR VALUE IN ACCORDANCE WITH COVENANTS AND i CONDITIONS GOVERNING SUCH SALE; AND APPROVING THE! SALE OF SUCH PROPERTY AND SAID DIS- POSITION AND qBVELOPMENT AGREEMENT. WHEREAS, the 4naheim Redevelopment Agency (- Agency-) is engaged in activitier necessary to execute and implement the Redevelopment Plan qthe -Redevelopment Plan-) for Redevelop- ment project Alpha (~he -Project-); and WHEREAS, in order to implement the Redevelopment Plan, as amended, the Agen~y proposes to sell, pursuant to the terms and conditions of ~ Disposition and Development Agreement, certain real propertY (the -Site-), described as Heritage Square Parcel #2, a d certain chattel property (the - Struc- ture-) located at 21 . S. Lemon street in the project; and WHEREAS, to the Agency a and Development equitable price Plan; and Mary; Ferguson (the -Developer-) has submitted writ~en offer in the form of said Disposition Agre~ment to purchase the Site at a fair and for ~ses in accordance with the Redevelopment WHEREAS, the proposed Disposition and Development Agreement contains a~l the provisions, terms, conditions, and obligations required Iby State and local law; and WHEREAS, the Agency has determined that Developer possesses the qualiftcations and financial resources necessary to acquire and ensur' development of the Site and structure in accordance with the ~urposes and objectives of the Redevelop- ment Plan; and WHEREAS, purs~ant to such provisions of the California community Redevelopmtnt Law, the Agency and the city Council of the city of Ana~eim (the -City CounciP) held a joint public hearing on th~ proposed sale of the site and Structure and the proposed Dis~osition and Development Agreement; and ~ WHEREAS, the ~ommunity Redevelopment Commission of City of Anaheim hasl reviewed said proposed Disposition Development Agreement and has recommended its approval by city Council and the !Agency; and the and the - 1 - 0644R ,-. - ~ WHEREAS, the Agency has prepared a Summary setting forth the cost of th~ Disposition and Development Agreement to the Agency, the esti~ated value of the interest to be conveyed determined at the hi,hest uses permitted under the Redevelop- ment Plan and the P4rchase price, and has made said summary available for pUbLic inspection in accordance with the California Community ~edevelopment Law; and WHEREAS, the 1gency has certified the Initial study of Environmental Impact i prepared by Agency staff and has deter- mined that sale and !development of the Site pursuant to the proposed Disposition land Development Agreement is in the best interest of the City i and the health, safety, morals, and wel- fare of its resident!.; is in accord with the public purposes and provisions of ap licable state and local law and require- ments; and is necessa y to effectuate the Redevelopment Plan. NOW, THEREFOR~, BE IT RESOLVED BY THE CITY COUNCIL OF THB CITY OF ANAHEIM A~ FOLLOWS: 1.
