84R-353 -, .--" RESOLUTION NO. 84R-353 ~, A RESOLUThN OF THE CITY COUNCIL OF THE CITY OF ANAHEI AWARDING A CONTRACT FOR THE CONSTRUCT ON OF WATER IMPROVEMENTS IN WEIR CANYON RO , IN THE CITY OF ANAHEIM, ACCOUNT NO. 54-61'-6329-01743-34390. WHEREAS, the City Council of the City of Anaheim did cause to be publish d in a newspaper of general circulation, published and circu,ated in the City of Anaheim, to wit: The Anaheim Bulletin, o~ the 19th and 26th days of July, 1984, a notice inviting sealed pro~osals for furnishing the following: All plant, lab~r, services, materials and equipment, and all uti1it~es and transportation, including power, fuel and water~ and performing all work necessary to construct and ~omplete in a good and workmanlike manner, in str~ct accordance with the specifications, plans and draw~ngs therefor on file in the Office of the City Engin~er or City Clerk of the City of Anaheim, the following ~Ub1ic improvement, to wit: Water improvemints in Weir Canyon Road, in the City of Anaheim, consi ting of the construction of 36ft steel water main inc uding all connections, va1ving, etc. and all appurtenant work as shown on the plans and specifically d~.lineated in the contract documents on file in the of~ice of the City Engineer, Account No. 54-6l3-6329-0l~43-34390, in accordance with ~he design, plans, profiles and specifications of said public imprpvement on file in the Office of the City Clerk of the City of Anah~im: and 1"""""', WHEREAS, ~aid notice inviting sealed proposals for said public improvement ~id provide that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of the City of Anaheim! up to the hour of 2:00 o'clock P.M. on the 16th day of August, 1984~ for the furnishing of all plant, labor, services, materials, and equipment, all utilities and transporta- tion, including pow~r, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of ~ages in the locality in which this type of labor is to be perfbrmed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the offices of the City Clerk and City Engineer: and i ,..... .- WHEREAS, tpe City Clerk of the City of Anaheim did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 16th day of A~gust, 1984, in response to the notice afore- said inviting sealed! proposals, to wit: ...-.... , - NAME TOTAL PRICE ALBERT W. AND WHERE~, the City Engineer did thereupon examine and tabulate said sealed! proposals and did report to the City Council the result of his ex~mination and tabulation: and WHEREAS, t~e City Council finds that the sealed proposal submitted by ALBERT ~. DAVIES, 8737 Helms Avenue, Rancho Cucamonga, California 91730, isl the lowest responsible proposal submitted for the furnishing of al~ plant, labor, services, materials and equipment, all utili~ies and transportation, including power, fuel and water and perfo~ing all work necessary to construct and complete in a good ~d workmanlike manner, in strict accordance with the specificati~ns, plans and drawings therefor on file in the Office of the City dlerk of the City of Anaheim, the public improvement hereina~ve mentioned and described, together with the appurtenances there~, and as specified in the notice inviting sealed proposals, a~ that said proposal of said above-named bidder should be accepted ~d a contract awarded to said bidder in accordance therewit~: and WHEREAS, ~he City Council finds that the above-mentioned sealed proposal is ~e lowest responsible proposal received and that the person, fi~m or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. ,.,....... NOW, THER~FORE, BE IT RESOLVED by the City Council of the City of Anaheim tha~ the sealed proposal submitted by said contractor for the ~urnishing of all plant, labor, services, materials and equip~ent, all utilities and transportation, including power, fu~l and water, and performing all work necessary to construct and co~plete, in a good and workmanlike manner, in strict accordance w~th the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim and the not~ce inviting sealed proposals, the public works and improvement her~inabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the construction and completion of said public improvement be, and the same is hereby, awarded to the said above-named bidder. -2- ~, -, ,"-" AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each cqntract awarded as hereinabove set forth, shall be, and they are her~by required to execute a contract in t~e required form with ~.e City of Anaheim upon the terms and condi- ti..O n. s speci f.'ied in t,e notice inviting sealed proposals and the proposal submitted said successful bidder or bidders and in accordance with the lans and specifications for said public improvement hereina , ve described, and in accordance with the terms, conditions a~ provisions of this resolution, and that said successful bidder or' bidders to whom each contract is awarded shall be required to furni~h a surety bond in an amount equal to one hundred percent (100') of the contract price for all labor, materi- als and equipment to be furnished and performed, as set forth in the sealed proposal $ubmitted by said bidder for the construction of said public imprd.vement, together with the appurtenances thereto or such portion ther~f as is covered by said conttact, as security for the faithful per~ormance of said contract, and a separate surety bond in an a~unt equal to one hundred percent (100%) of the construction cost of: said public improvement covered by said con- tract, as security fbr the payment of all persons performing labor and furnishing material for said project. AND BE IT ~RTHER RESOLVED that said successful bidder or bidders be, a.nd theYt.are herepy, required to furnish to the City of Anaheim in companiesisatisfactory to the City of Anaheim, public liability, property damage, compensation, and other insurance in the amounts and for the purposes set forth and specified i~ the notice inviting seal~ proposals, and subject to the approval of the City Attorney as, to form and sufficiency. , ,,-.., AND BE IT fuRTHER RESOLVED that the Mayor and the City Clerk of the City ofiAnaheim be, and they are hereby, authoTized and directed to make!, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bidder or b~~ders for the f~rnishing of all plant, labor, materials, and equipment and perfoJ;:,.ing all work, as hereinabove more particularly described, for the cbnstruction, installation and completion of said public improvem~nt hereinabove described upon the terms and conditions as specif~ed in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifi- cations and detailed specifications and drawings, and all addenda thereto, and all mod~fications incorporated therein prior to the date of the opening of bids, on file in the Office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this resolution, and in accord- ance with all of the contract documents herein specified.
