CITY AT OF WHEREAS, 1~e City ~ouncil of the City of Anaheim did cause to be PUbliSh~,', in a n,wspaper of general circulation, published and circu ated in the City of Anaheim, to wit: The Anaheim Bulletin, o~ the 2nd and 9th days of August, 1984, a notice inviting sealed protosals for furnishing the following: All plant, lab~r, servi~es, materials and equipment, and all utilit~es and transportation, including power, fuel and water~ and performing all work necessary to construct and ~~mplete in a good and workmanlike manner, in strttt accordance with the specifications, plans and drawings therefor on file in the Office of the City Engin er or City Clerk of the City of Anaheim, the following public improvement, to wit: Construction of a l6-in~h diameter well at the Dad Miller Golf Co*tse, in the City of Anaheim, consisting of furnishing c:bf all lab>or, 'naterial, tools, supplies, equipment and ,~purtena.ces, necessary for the complete and satisfactott construction and testing of either a cable tool, or~ conventional hydraulic rotary or reverse rotaryiarilled ,ravel envelope well as shown on the plans and t'~ecifiCallY delineated in the contract documents on f,1e in the Office of the City Engineer, Account Nos. 61-512-7107 and 64-308-7107; and in accordance with ~he design, plans, profiles and specifications of said pUblic impr~vement on file in the Office of the City Clerk of the City of Anah.im; and .~ WHEREAS, .~id notice inviting sealed proposals for said public improvement .id provi&e that sealed proposals would be received by the Citfof Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 2:00 o'clock P.M. on the 23rd day of August, 1984, for the furnishing of all plant, labor, services, materials and equipment, all utilities and transporta- tion, including power, fuel and water, and performing all work necessary to constr,ct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the pre- vailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the offices of the City Clerk and City Engineer; and ,- ,""" WHEREAS, the City Clerk of the City of Anaheim did receive the followi$g sealed proposals prior to 2:00 o'clock P.M. on the 23rd day of August, 1'84, in response to the notice afore- said inviting seale. proposals, to wit: l"'.'....\ NAME - TOTAL PRICE WATER WELL SUPPLY . . . . . . . . . . . . . . . . $47,500.00 . $52,391.00 $55,460.00 . $63,898.00 BEYLIK DRILLING, IN~. . . . . . . . . . . . AND WHER~, the City Engineer did thereupon examine and tabulate said seale4iproposals and did report to the City Council the result of his e*~minatio. and tabulation; and WHEREAS, the City Council finds that the sealed proposal submitted by WATER .~LL SUPPLY, INC., 11234 So. Norwalk Boulevard, Santa Fe Springs, C.1ifornia 90670, is the lowest responsible pro- posal submitted for the furnishing of all plant, labor, services, materials and equip.~nt, all utilities and transportation, includ- ing power, fuel and'Water and performing all work necessary to construct and compl.te in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office ~f the City Clerk of the City of Anaheim, the public improvement ~~reinabove mentioned and described, together with the appurtenan,es thereto, and as specified in the notice inviting sealed pro~sals, amd that said proposal of said above- named bidder should'be accepted and a contract awarded to said bidder in accordanc. therewith; and WHEREAS, tbe City Council finds that the above-mentioned sealed proposal is the lowest responsible proposal received and that the person, fit~ or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal sub- mitted is the best $uited and fitted for the pUblic improvement to be constructed. ,...... , NOW, THER'fORE, BE IT RESOLVED by the City Council of the City of Anaheim tha~ the sealed proposal submitted by said contrac- tor for the furnish~ng of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and perf~rming all work necessary to construct and com- plete, in a good an~ workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City ~1erk of the City of Anaheim and the notice inviting sealed proto sa Is, the public works and improvement herein- above more particul_rly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the construction and completion of said public improvement be, and the same is hereby, awarded to the said above- named bidder. -2- - ~ ~, AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each cq~tract awarded as hereinabove set forth, shall be, and they are he~.by required to execute a contract in the required form with ~he City of Anaheim upon the terms and condi- tions specified in ~~e notic~ inviting sealed proposals and the proposal submitted ijy said successful bidder or bidders and in accordance with the 'plans and specifications for said public improvement hereinaijove described, and in accordance with the terms, conditions a4d provisions of this resolution, and that said successful bidder ot bidders to whom each contract is awarded shall be required to furn!$h a surety bond in an amount equal to one hundred percent (lOQ%) of the contract price for all labor, materi- als and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public imprQvement, together with the appurtenances thereto or such portion the~eof as is covered by said contract, as security for the faithful pettformance of said contract, and a separate surety bond in an a~ount equal to one hundred percent (100%) of the construction cost o~ said public improvement covered by said con- tract, as security for the payment of all persons performing labor and furnishing matetial for said project.
