said notice did sta and declare that, pursuant to the provisions
of Section 1770 of t e Labor Code, the City Council of the City of
Anaheim had ascertai ed the prevailing rate of wages for each type
of labor needed to ecute said contract, and did state that the
prevailing hourly w e scale so ascertained was on file in the
Office of the City erk; and

WHEREAS, 0 the 16th day of February, 1984, at the hour
of 2:00 o'clock P.M., the City Clerk and the City Engineer of the
City of Anaheim did open said sealed proposals received up to that
time for the furnis ing of all plant, labor, services, materials
and equipment, and 11 utilities and transportation, including
power, fuel and wat r, and performing all work necessary to
construct and compl te, in a good and workmanlike manner, in
strict accordance w'th the specifications, plans and drawings
therefor on file in the Office of the City Clerk of the City of
Anaheim, the PUbliC~improvement hereinabove more particularly
described and set f rth, in public, in the City Council Chamber in
the City Hall, Anah im, California, and the City Engineer did
tabulate the result of said sealed proposals and did make a report
to the City Council at a meeting held no later than thirty (30)
days after the bids were opened; and
WHEREAS, t City Council of the City of Anaheim did, at
a subsequent regula or adjourned regular meeting, held on the
13th day of March, 984, at the hour of 10:00 o'clock A.M.,
consider the sealed proposals submitted for furnishing the
materials and perfo ing the work hereinabove more particularly
described and set f rth, and did thereupon find and determine that
the sealed proposal submitted by A & A PIPELINE, INC., 6700
Stanton Avenue, Sui e E, Buena Park, California 90620 for the
construction, insta lation and completion of said La Palma Avenue
relief sewer from 4 feet west of East Street to 1188 feet west of
East Street, in the City of Anaheim, Account No. ll-790-6325-E0480
hereinabove mention d and described, was the lowest responsible
proposal submitted erefor, and thereupon accepted said bid and
did award a contrac to said contractor for furnishing all plant,
labor, services, ma erials and equipment and all utilities and
transportation, inc uding power, fuel and water, and performing
all work necessary 0 construct and complete, in a good and
workmanlike manner, dn strict accordance with the specifications,
plans and drawings, Ithe said public improvement as speci fied in
said notice invitin~. sealed proposals, and did authorize the Mayor
and the City Clerk f the City of Anaheim to execute a contract
for and on behalf 0 the City of Anaheim with said contractor,
which said contract Iwas duly made and entered into on the 9th day
of April, 1984; and I

WHEREAS, t e said contractor has furnished all plant,
1abor, services, ma eria1s and equipment and a11 uti1ities and
transportation, and performed all work necessary for the
construction and co pletion, in a good and workmanlike manner, in
strict accordance w"th the specifications, plans and drawings of
said public improve ent as specified in the notice inviting sealed
proposals and in th detailed designs, plans, drawings and
specifications prep red by the Public Works Department, and the
contract made and e tered into with said contractor by the City of
Anaheim; and

WHEREAS, ti'e Public Works Executive Director has duly
certified to the co truction and completion of said public
improvement hereina,ve mentioned and described, in accordance
with the plans andecifications and the contract documents duly
made and entered in. with said contractor; and

WHEREAS, t City Council finds that said contractor has
completed said publ'c improvement hereinabove more particularly
described in accord ce with the provisions of the contract and
the contract docume ts, and that notice of completion should be
filed and payment 0 the balance due said contractor authorized in
accordance with the contract documents.

NOW, THERE RE, BE IT RESOLVED by the City Council of the
City of Anaheim tha all plant, labor, services, materials and
equipment and all u ilities and transportation, and the
performance of all rk necessary to construct, install and
complete in a good d workmanlike manner, in strict accordance
with the specificat' ns, plans and drawings therefor on file in
the Office of the City Clerk of the City of Anaheim, together with
the appurtenances t ereto, said public improvement hereinabove
more particularly d cribed and set forth, in the City of Anaheim,
by said contractor, e, and the same are hereby, accepted subject,
nevertheless, to althe terms, conditions and provisions of the
contract documents, nd that the balance due said contractor for
said work be paid tq said contractor thirty-five (35) days from
and after final ace tance of said work as evidenced by the
adoption of this re lution, but not sooner than thirty (30) days
after the date of t e filing of notice of completion, excepting
only such sum or su as may lawfully be withheld in accordance
with the provisions f said contract and contract documents. That
acceptance by the c tractor of said payments made in accordance
with said final est' ate shall operate and shall be a release to
the Ci ty of Anaheim,! its officers, agents and employees from all
claims and liabilit$es due the contractor for anything done or
furnished or withhe '. or for anything relating to the work or any
act or neglect of t ' City, its officers, agents and employees,
excepting only clais against the City for amounts withheld by the
City at the time of Isuch payment.
AND BE IT =RTHER RESOLVED that the Mayor be, and he is
hereby, authorized . execute and file a notice of completion of
said work as requir by law.
