84R-307 - --., RESOLUTION NO. 84R-307 A RESOLUT~N OF THE CITY COUNCIL OF THE CITY OF ANAHEI~ GRANTING VARIANCE NO. 3406. .~ WHEREAS, ~fter a request for variance by STEPHEN C. WALKER and BARBARA 1 WALKER, was received, a public hearing before the Planning ommission of the City of Anaheim was held upon due and proper otice, a result of which Variance No. 3406 was granted covering! the following described property: LOT 31 OF TRAC~NO. 9465, AS SHOWN ON A MAP RECORDED IN BOOK 402, PES 40 TO 44 INCLUSIVE OF MISCELLANEOUS MAPS, RECORDS 0 SAID ORANGE COUNTY; and WHEREAS, t~ereafter, within the time prescribed by law, an interested party ~r the City Council, on its own motion, caused the review of said Ptanning Commission action at a public hearing noticed and held as rescribed by law and, as a result thereof, the City Council does he! eby make the following findings: 1. That there! are special circumstances applicable to the property, including bize, shape, topography, location or surroundings, which bo not apply to other property under identical zoning classificatio~ in the vicinitYi and 2. That, beca~. se of special circumstances shown in (1) above, strict apPlic. tion of the zoning code deprives the property of privileges enjoye by other property under identical zoning classification in th vicinity; and WHEREAS, tpe City Council does further find and determine with regard to the p~oposed waiver of certain off-street parking requirements that: . 1. The varianpe will not cause an increase in traffic congestion in the im~ediate vicinity nor adversely affect the adjoining land usesi1and 2. The grantit9 of the variance under the conditions imposed will not be detrimen al to the peace, health, safety or general welfare of the citiz,ns of the City of Anaheim. i I.~'- NOW, THEREfORE, BE IT RESOLVED by the City Council of the City of Anaheim thatia conditional zoning variance be, and the same is hereby, granted p~rmitting construction of an addition to a single-family reside~ce on the property hereinbefore described with waivers of the follo~ing sections of the Anaheim Municipal Code: SECTIONS 18.06.050.011 AND l8.24.~66.0l0 Minimum number of parking (4 off-street spaces requiredi 3 spaces proposed) SECTION l8.24.0~3.0ll4 Minimum garage setback. (25 feet required from a cul-de-sac; 15 to 23 feet proposed) '\ .,~ .-. That said variance be granted subject to the following conditions: ",...... 1. That a ro~l-up garage door shall be installed and maintained on that :'ortion of the garage containing the northernmost enclos d parking space which is located less than twenty-five (25) fe ,t from the cul-de-sac, as required by the City Traffic Engineer. 2. That SUbj~ct property shall be developed substantially in accordance with pIa s and specifications on file with the City of Anaheim marked Exhi ,it Nos. 1 through 3. 3. That prio~ to final building and zoning inspections, Condition Nos. 1 and 2, above-mentioned, shall be complied with. BE IT FUR1~ER RESOLVED that the City Council of the City of Anaheim does her~by find and determine that adoption of this R,solution is expre~Sly predicated upon applicant's compliance with each and all of the !conditioQ.s hereinabove set forth. Shouldany such condition, or 4ny part thereof, be declared invalid or unenforceable by th~ final judgment of any court of competent jurisdiction, then ~his Resolution, and any approvals herein contained, shall be 'deemed null and void.
