RESOLUTION NO. 84R-257 ,.-", A RESOLUTION,OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALfORNIA, ADOPTING REGULATIONS FOR CANDIDATES F R ELECTIVE OFFICE, PERTAINING TO MATERIALS SU ITTED TO THE ELECTORATE AND THE COSTS THEREO FOR THE GENERAL MUNICIPAL ELECTION TO E HELD IN SAID CITY ON TUESDAY, THE 6TH DAY PF NOVEMBER, 1984. WHEREAS, SeCtiOn 10012 of the Elections Code of the State of California authorizes t e governing body of any local agency to adopt regulations pertaining 0 materials prepared by any candidate for a municipal election, inc~uding costs thereof; and WHEREAS, it ~s the opinion of the Attorney General of the State of California (No~ CV76/5, May 6, 1976) that a candidate may not be billed for the addition,l cost of preparing candidates' statements in Spanish if such were no~ requested by the candidate but were required solely by reason of rec~nt amendments to the Federal Voting Rights Act of 1965 (Public Law 94-73, August 6, 1975); NOW, THEREFO~, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES HEREBy! RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. ~hat pursuant to Section 10012 of the Elections Code of the State of C~ifornia, each candidate for elective office to be voted for at the Genera~ Municipal Election to be held in the City of Anaheim on the 6th day ~f November, 1984, may prepare a candidate's statement on an appropL~ate form provided by the City Clerk. Such statement may include t~e name, age and occupation of the candidate and a brief description of n~ more than two hundred (200) words of the candidate's education ~d qualifications expressed by the individual candidate. Such state~nt shall not include party affiliation of the candidate, nor members~p or activity in partisan political organizations. Such s~tement shall be filed in the office of the City Clerk at the time the ~ndidate's nomination papers are filed. Such statement may be withd~wn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after close of the nomination peridd. SECTION 2. ~hat in compliance with the recent amendments to the Federal Voting Rig~ts Act of 1965 (Public Law 94-73, August 6, 1975) the City Clerk shall p~vide a Spanish translation of the candidate's statement to be includ~ in the Voter's Pamphlet and mailed with the sample ballot to each ~oter in said City. . ...-..... SECTION 3. That the City Clerk shall send to each voter with the sample ballot, a vqter's pamphlet which contains the statement of each candidate in Engl~sh and Spanish pursuant to law. ,,-..., -.. SECTION 4. Xhat each candidate filing a candidate's statement shall be billed for the services rendered, a sum not greate~ than the actual prorated costs olE printing and handling for the English version only, and such bill sha~l be due and payable no later than seven (7) days after said bills are r~~eived by the candidate. -.. SECTION 5. ~t the ctty Clerk is hereby authorized and directed to send said ~l18 by certified mail. SECTION 6. ~at the Ctty Council finds and determines that no materials, other than t~e voters pamphlet containing the candidate's statement, shall be se~ to voters with the sample ballot. SECTION 7. ~hat the City Clerk shall provide each candidate or the candidate's repr~sentative a copy of this Resolution at the time nominating petitions a~ issued. SECTION 8. ~hat the City Clerk shall certify to the passage aDd adoption of this Re~olution; shall enter the same in the book of original Resolutions o~ said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minu~s of the meeting at which the same is passed and adopted.
