RESOLUTION NO. 78R- 575
A RESOLUTtON OF THE CITY COUNCIL OF THE
CITY OF .~..HEIM RESCINDING THAT PORTION
OF RESOL tON NO. i3R-579 WHICH HAD
AUTHORIZE THE INCIDMBENT OF THE OFFICE
OF CITY AGER TO MAKE DISABILITY RETIRE-
MENT DETE,INATION$. .
WHEREAS, 4he City of Anaheim is a contracting agency
of the Public Emplo)/'ees' Retirement System; and
!
WHEREAS, ~he Public Employees' Retirement Law,
Government Code, Se ttion 21020 etseq. requires a contracting
agency to determine I hether an employee of such agency is
incapacitated for d~.sability retirement and whether such
disability is indust:!rial within the meaning of such law; and
WHEREAS, the Public Employees' Retirement Law,
Government Code, Sedtion 21034 confers upon the City Council,
the governing body of the contracting agency, the right to
delegate any authortty or duty imposed under Government Code
Section 21020 et seq. to a subordinate officer; and
WHEREAS, ~solution No. 73R-579 dated November 27,
1973 did delegate tofthe incutnbent of the City Manager the
authority to make di~ability retirement determinations; and
WHEREAS, it is no longer in the best interest of
the City of Anaheim to delegate the authority to make disability
retirement determinations.
NOW, THEREtORE, BE IT RESOLVED that the authority
tol make disability r,tirement determinations and to certify
de~erminations to th~ Public Employees' Retirement System is
nol longer delegated to the incumbent of the office of the City
Mapager and such authority reverts back to the City Counc.il of
th~ City of Anaheim.
I BE IT FURT'ER RESOLVED that in all other respects
Re~olution No. 73R-519 remain$ in full force and effect.
