WHEREAS, said notice inviting sealed proposals for said
public. improvement dip. provide that sealed proposals would be
received by the City pf Anaheim at the Office of the City Clerk
of the City of Anahei~; up to the hour of 2:00 o'clock P.M. on

notice did state and tl~clare that pursuant to the provisions
of Section 1770 of the Labor Code, the City Council of the City
of Anaheim had ascerta~ned the prevailing rate of wages in the
locality in which thi$' type of labor is to be performed for
each craft or type of'workman or mechanic needed to execute the
contract, and which w.ge scale is on file in the Offices of the
City Clerk and City E~gineer; and
WHEREAS, the C~ty Clerk of the City of Anaheim did

hereinabove mentio~d and described, together with the appurten-
ances thereto, and ,as specified in the notice inviting sealed
proposals, and thatjsaid proposal of said above-named bidder
should be accepted ~nd a contract awarded to said bidder in
accordance therewith; and
WHEREAS, t~ City Council finds that the above-mentioned
sealed proposal is itjhe lowes't responsible proposal received and
that the person, fi~ or corporation submitting said proposal
is a responsible p~son, firlm or corporation and that the pro-
posal submitted is ~he best suited and fitted for the public
improvement to be cpnstructed.
NOW, THERErpRE, BE IT RESOLVED by the City Council of
the City of Anahei~ithat the sealed proposal submitted by said
contractor for the !f1urnishing of all plant, labor, services,
materials and equip~ent, all utilities and transportation,
including power, f~ll and water, and performing all work
necessary to constr~ct and complete, in a good and workmanlike
manner, in strict aCicordance with the specifications, plans and
drawings therefor o~ file in the Office of the City Clerk of the
City of Anaheim~mrl,tlle notice invi tinE sealed proposals, the
public works and int>lrovement hereinabove more particularly men-
tioned and describe~. together with the appurtenances thereto,
~e, and the same is, hereby, accepted, and that a contract for the
construction and co~letion of said public improvement be, and
the same is hereby,. awarded to the said above-named bidder.

AND BE IT F~~THER RESOLVED that the successful bid~er
or bidders upon eac~ contract awarded as hereinabove set forth,
shall be, and they ~~e hereby required to execute a contract in
the required form wtiith the City of Anaheim upon the terms and
conditions specifie~ in the notice inviting sealed proposaJ.s and
the proposal submit~~d by said successful bidder or bidders nnri
in accordance with the plans and specifications for said pui,lic
improvement hereinabpve described, and in accordance with the
terms, conditions app provisions of this resolution, and that
said successful bidU~r or bidders to whom each contract is awarded
shall be required tp furnish a surety bond in an amount equal to
one hundred per cen~ (lOO%) of the contract price for all labor,
materials and equip~nt to be furnished and performed, as set
forth in the sealed: proposal submitted by said bidder for the
construction of saia' public improvement, together with the appur-
tenances thereto or such portion thereof as is covered by said
contract, as security for the faithful performance of said contract,
and a separate surety bond in an amount equal to one hundred per
cent (100%) of the construction cost of said public improvement
covered by said contract, as security for the payment of all
persons performing lahor and furnishing material for said project.

AND BE IT FURTHER RESOLVED that said successful hidder
or bidders be, and ~ey are hereby, required to furnished to the
City of Anaheim in q~mpanies satisfactory to the City of Ana~eim,
public liability, p~perty d~mage, compensation, and other insur-
ance in the amounts I~nd for the purposes set forth and specified
in the notice invit~g sealed proposals, and subject to the
approval of the Cit~!Attorney as to form and sufficiency.
AND BE IT i~URTHER RESOLVED that the Mayor and the City
Clerk of the City o~Anaheim be, and they are hereby, authorized
and directed to mak~, execute and enter into, for and on behalf
of the City of Anahef~m, a ,.,ritten contract with said successful
bidder or bidders f~ the fu~ishing of all plant, labor, mater-
ials, and eqUiPment!. d performing all work, as hereinabove more
particularly descri . d, for the construction, installation and
completion of said ,I lic improvement hereinahove described upon
the terms and condi~ons as specified in the notice inviting
sealed proposals, th~ detailed design, plans, profiles, drawings
and general specific~tions and detailed specifications and draw-
ings, and all addend~! thereto, and all modifications incorporated
therein prior to the! date of the opening of bids, on file in the
Office of the City C~erk of the City of Anaheim and in strict
accordance with the ~rms, conditions and provisions of this reso-
lution, and in accoraance with all of the contract documents herein
specified.
